2004-009ECORDRESOLUTIONNO. 04-009 OFFICIAL R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, I, TEXAS, ADOPTING REVISIONS TO THE SOUTHLAKE PUBLIC LIBRARY'S INTERNET POLICY DEFINING PROVIDED SERVICES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake (the "City") strives to achieve the maximum efficiency and effectiveness in the delivery of services to its residents; and WHEREAS, the City Council established policies for the Southlake Public Library (the Library") prior to the opening of the facility in order to provide systematic and consistent guidance in the administration of providing library services; and WHEREAS, the City recognizes the importance of the use of electronic (computer) resources including the Internet and the need to better define resultant services; and WHEREAS, the City recognizes that there are network security issues regarding Internet use and that the Library recognizes that certain restrictions on use of electronic (computer) resources will sometimes be necessary; and WHEREAS, the City recognizes that the Library has a responsibility to police Intemet use and avoid any misuse of electronic (computer) resources, including, but not limited to viewing of obscene materials; and WHEREAS, the City recognizes that due to user expertise and other technology it is possible to access obscene or offensive sites. The City makes no guarantee that such access will not occur, even with the use of filters, but will take necessary action if and when such unwarranted access occurs; and WHEREAS, the City recognizes that the Library cannot guarantee access to all web sites, and if a particular site is inaccessible, the library cannot assume responsibility for any lack of availability. The Library can also not guarantee that items found on the Internet can be printed or reproduced; and WHEREAS, the City recognizes that it assumes no liability or responsibility resulting from the use of its computer system, selection of filtering systems, data information, including personal credit card or other financial account information; and WHEREAS, The City desires to establish these revisions in the current Intemet Policy to provide systematic and consistent guidance in the administration of these desired policy goals; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,THAT: Section 1: The City of Southlake hereby adopts the proposed revisions to the Library's Intemet Policy defining provided services, a copy of which is attached hereto as Exhibit "A" and which is incorporated by reference herein. L" -'a LoriA. arwell, City Secretary WambsgNass, MayorvZHlqt-nwf O• U' 12004. 7 Southlake Public Library Board Policies and Procedures Manual Policy: Internet Policy Source: Library Board Category: Administration Effective Date: January 2, 2001, Revised February 3, 2004 Statement of Purpose The purpose of this policy is to provide consistent guidance for the public use of the Internet at the Southlake Public Library. Policy Statement The Library is not a full service Internet provider. Services which will not be available include, but are not limited to, ability to download to any drive on a computer (except designated computers), newsgroups, chatlines, and personal electronic e-mail accounts. The Library cannot guarantee access to all web sites and if a particular site is inaccessible the library cannot assume responsibility for any lack of availability. We also cannot guarantee that items found on the Internet can be printed or reproduced. Patrons will not be permitted to load their own software. Anyone wishing to utilize the Internet must possess a valid driver's license or photo identification. The City of Southlake disclaims any responsibility to monitor for or prevent viruses that may be transmitted electronically. Patrons are advised to take precautions for eliminating virus or other software corruption. The City of Southlake will employ filtering software on all Internet capable computers in accordance with applicable Federal mandates. The City of Southlake does not promote or condone the use of its computer system for illegal purposes and expressly prohibits the same as well as accessing illegal sites. Further, the City finds there is material on the Internet, while not obscene, that is not appropriate for minors due to explicit sexual descriptions or graphics. The City recognizes that minors may utilize Library resources, including the Internet, outside of their parents' presence. The City of Southlake, through the Library, has a compelling interest to assist parents in protecting the welfare of minors** who are vulnerable and unable to make critical decisions in an informed and mature manner. Failure to abide by the aforementioned policy may result in a one-week suspension of computer privileges. Subsequent violations may result in the loss of any and all library privileges for twelve months. Even filters cannot insure that obscene and other illegal materials are not available. Due to the Internet capability to constantly change and establish new sites, user expertise, and other technology, it is still possible to access illegal, obscene or offensive sites. The City of Southlake makes no guarantee that such access will not occur even with the use of filters, but will take necessary action if and when such unwarranted access occurs. The selection of a filtering program is solely within the discretion and IV judgement of the City. Users must accept responsibility for information displayed or printed during their Internet session. THE CITY OF SOUTHLAKE EXPRESSLY DISCLAIMS ANY LIABILITY OR RESPONSIBILITY RESULTING FROM THE USE OF ITS COMPUTER SYSTEM, SELECTION OF A FILTERING PROGRAM, ACCESS TO THE INTERNET, DATA, INFORMATION, INCLUDING CREDIT CARD OR OTHER FINANCIAL INFORMATION, OR MATERIAL ON THE INTERNET, OR THE USE OR MISUSE OF INFORMATION FROM THE INTERNET.
