2001-002 ResolutionRESOLUTION NO. 01-002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A TELECOMMUNICATION TOWER ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS LOT 2112, L.B.G. HALL NO. 686 ADDITION, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT RECORDED IN CABINET A, SLIDES 5299 & 5300, PLAT RECORDS, TARRANT COUNTY, TEXAS; AND TRACTS 1, 1B, 1C1, 1C2, 1C3, 1E, 2B, 2A1, 2B1, 3C, 3D, 3D1A, AND 3D6, SITUATED IN THE LITTLEBERRY G. HALL SURVEY, ABSTRACT NO. 686, AND BEING APPROXIMATELY 61.61 ACRES, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a telecommunication tower has been requested by a person or corporation having a proprietary interest in the property zoned as "S -P-1" Detailed Site Plan District with "CS" Community Service District uses to include limited outside storage; and, WHEREAS, in accordance with the requirements of Sections 45.1 (38) and 45.8 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a telecommunication tower on the property being legally described as Lot 2R2, L.B.G. Hall No. 686 Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slides 5299 & 5300, Plat Records, Tarrant County, Texas; and Tracts 1, 1B, 1C1, 1C2, 1C3, IE, 2B, 2A1, 2B1, 3C, 3D, 3D1A, and 3D6, situated in the Littleberry G. Hall Survey, Abstract No. 686, and being approximately 61.61 acres, more fully and completely described in Exhibit "A", and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions, if any, shall be applicable to the granting of this Specific Use Permit: 1. Allowing the placement of the light pole with the first preference being to light the basketball courts and the second preference being either in the parking lot, or adjacent to Field #9; 2. Allowing placement of the lights as low on the poles as possible to effectuate light in the area but not having it any higher than is necessary; 3. Permitting a 75' pole for the tower; 4. Including the placement of shrubbery; 5. Requiring the placement of the box as close to the restrooms as possible with screens around it; 6. Such other conditions as established in the motion made by the City Council at the regular meeting on January 16, 2001, attached hereto and incorporated herein as Exhibit 'C'. SECTION 2.
