1999-079Resolution No.99-79 Page 1 RESOLUTION NO. 99-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES FOR ON -PREMISE CONSUMPTION ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS LOT 2, BLOCK 1, 1709 SOUTHLAKE OAKS ADDITION, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT RECORDED IN CABINET A, SLIDE 3231, PLAT RECORDS, TARRANT COUNTY, TEXAS, AND BEING APPROXIMATELY 1.8685 ACRES, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED CONCEPT PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for the sale of alcoholic beverages for on -premise consumption has been requested by a person or corporation having a proprietary interest in the property zoned as "C-2" Local Retail Commercial District; and, WHEREAS, in accordance with the requirements of Sections 45.1 (1) and 45.6 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for the sale of alcoholic beverages for on -premise Resolution No.99-79 Page 2 consumption on the property being legally described as Lot 2, Block 1, 1709 Southlake Oaks Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slide 3231, Plat Records, Tarrant County, Texas, and being approximately 1.8685 acres, more fully and completely described in Exhibit "A", and as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1. This Specific Use Permit shall expire seven years from the date of issuance of the Certificate of Occupancy, as established in the motion made by the City Council at the regular meeting on December 7, 1999, attached hereto and incorporated herein as Exhibit "C." Motion: Boutte Commissioner King said he thinks seven years is appropriate. He thinks putting a time limit on SUPS which bears resemblance to the terms of the lease would be an appropriate amount of time. Commissioner Sandlin said he was comfortable with the first motion and he is not comfortable with the amendment so he thinks it would be proper for someone else to second it. Commissioner Shankland said he is not going to vote for this either. He said Council's wishes have been made clear, and this issue has been discussed. He cannot vote for this if there is a time, limit on it. Chairman Creighton said she would be opposed to a short term because she does not think that is particularly fair to an applicant who has invested lots of time and energy in a business.
