1998-031 ResolutionCity of Southlake, Texas RESOLUTION NO. 98-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, CANVASSING THE GENERAL AND SPECIAL ELECTIONS HELD ON MAY 2,1998; DECLARING THE RESULTS FOR COUNCILMEMBERS 3, 4, AND 5, AND JUDGE OF MUNICIPAL COURT; DECLARING THE RESULTS OF CHARTER AMENDMENTS; AND, PROVIDING AN EFFECTIVE DATE. WHEREAS, there was held in the City of Southlake, Texas, on May 2, 1998; a General Election for the positions of Councilmembers Places 3, 4, and 5, and Judge of Municipal Court; and a Special Election for the purpose of considering amendments to the Home Rule Charter of the City of Southlake, Texas; and, WHEREAS, there were cast at said election 2,593 votes as shown in the official election results heretofore lawfully submitted to the City Council of the City of Southlake, Texas, and filed with the City Secretary of said City; and, WHEREAS, only duly qualified resident electors of said city voted in said election, and said election was called and held in strict conformity with the laws of the State of Texas; and, WHEREAS, the results of said election were duly canvassed by the City Council of the City of Southlake, Texas, on May 5, 1998, and showed the following results: COUNCILMEMBER PLACE 3 PAMELA MULLER 859 RONNIE KENDALL 1,633 COUNCILMEMBER PLACE 4 DAVID A. HARRIS 846 DEBRA EDMONDSON 1,655 COUNCILMEMBER PLACE 5 JIM GIFFIN 762 GARY FAWKS 1,725 Resolution No. 98-31 Official Canvass of May 2, 1998 Election Page 2 JUDGE OF MUNICIPAL COURT BRAD BRADLEY 1,856 PROPOSITION NO. 1 Department of Public Safety Shall the language of the Charter of the City of Southlake be modified to conform with change the City Council made in December, 1991, as authorized by Section 4.01 of the City Charter, in combining the City's fire protection and police services into a department of public safety; by amending Sections 1.16 and 1.17? FOR 2,197 AGAINST 211 PROPOSITION NO.2 City Council Meetings Shall the Charter of the City of Southlake be amended to authorize the city council to cancel or move the date of a regular city council meeting by posting a 72 -hour notice in accordance with state law and to authorize the city council to vote by an electronic device which visually indicates the votes to those in attendance at a city council meeting; by amending Sections 2.09 and 2.11? FOR 1,591 AGAINST 828 PROPOSITION NO.3 Boards and Commissions Shall the Charter of the City of Southlake be amended to provide that a vacancy on a board or commission will be filled for the unexpired term; that members of city boards and commissions serve without compensation; that a person who holds a salaried or elected city office may not serve as a member of a city board or commission; that each board and commission shall keep minutes of its meetings which are public records; and that members of city boards and commissions serve at the pleasure of the city council and may only be removed by a majority vote of the council, except when otherwise provided by state law; amending Sections 3.02 and 11.03, and adding Section 4.02? FOR 2,203 AGAINST 367 Resolution No. 98-31 Official Canvass of May 2, 1998 Election Page 3 PROPOSITION NO.4 Planning and Zoning Commission Shall the Charter of the City of Southlake be amended so that the purpose and duties of the planning and zoning commission shall be as designated by ordinance and state law; providing that the city council may delegate matters concerning city parks to another board that has responsibilities relating to parks; and providing for planning and zoning commission review of all components of the Master Plan every four years, amending Sections 11.03, 11.04, and 11.06 and repealing Section 11.05? FOR 1,958 AGAINST 420 PROPOSITION NO. 5 Adoption of Ordinances Shall the Charter of the City of Southlake be amended to require that ordinances be passed at two meetings, the second of which must be a regular meeting; and to require reading of the ordinance caption only if requested by a member of the public or a city council member, amending Sections 3.11 and 3.13? FOR 1,830 AGAINST 522 PROPOSITION NO. 6 Correcting Provisions to Conform with State and Federal Law; Correcting Language Shall the Charter of the City of Southlake be amended to conform with state and federal law with respect to elections and statutory references; and to correct language regarding staggering of city council terms; amending Sections 1. 11, 2.02, 2.08, 2.09, 2.11, 3.07, 3.11, 7.10 and 7.32(b)? FOR 2,166 AGAINST 206 PROPOSITION NO. 7 Term Limitations for the Mayor and City Council Members Shall the Charter of the City of Southlake be amended to remove the restriction on the number of successive terms the mayor or a city council member may serve; repealing Section 2.03? Resolution No. 98-31 Official Canvass of May 2, 1998 Election Page 4 FOR 617 AGAINST 1,836 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. RONNIE KENDALL is hereby declared to have been elected to the Office of Councilmember Place 3, for a term to expire in May, 2001. DEBRA EDMONDSON is hereby declared to have been elected to the Office of Councilmember Place 4, for a term to expire in May, 2001. GARY FAWKS is hereby declared to have been elected to the Office of Councilmember Place 5, for a term to expire in May, 2001. BRAD BRADLEY is hereby declared to have been elected to the Office of Judge of Municipal Court, for a term to expire in May, 2001. Section 2.
