A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT
FOR OUTSIDE CONTAINERS ON PROPERTY WITHIN THE
CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED
AS APPROXIMATELY 2.53 ACRES SITUATED IN THE
THOMAS EASTER SURVEY, ABSTRACT NO. 474, TRACT 3A;
AND MORE FULLY AND COMPLETELY DESCRIBED IN
EXHIBIT "A," AND AS DEPICTED IN THE APPROVED SITE
PLAN ATTACHED HERETO AND INCORPORATED HEREIN
AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for outside storage has been requested by a person or
corporation having a proprietary interest in the property zoned as "S -P-2" Generalized Site Plan
District with certain "O-1" Office District, "I-1" Light Industrial District, and "B-1" Business Service
Park District uses; and,
WHEREAS, in accordance with the requirements of Section 45.1 (27) of the City's
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have
given the requisite notices by publication and otherwise, and have afforded the persons interested
and situated in the affected area and in the vicinity thereof, and,
WHEREAS, the City Council does hereby find and determine that the granting of such
Specific Use Permit is in the best interest of the public health, safety, morals and general welfare
of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for outside storage on the property legally
described as approximately 2.53 acres situated in the Thomas Easter Survey, Abstract No. 474, Tract
3A; as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit
A," subject to the provisions contained in the comprehensive zoning ordinance and the restrictions
set forth herein. The following specific requirements and special conditions shall be applicable to
the granting of this Specific Use Permit:
I. Subject to Plan Review Summary No. 6 dated March 1, 1996,
2. Modifying item #2 to accept the driveways as submitted,
3. Deleting item #3 to the extent as requested by the applicant.

SECTION 2.
This resolution shall become effective on the date of approval by the City Council.

EXHIBIT "A"
BEING the remnant of a 7.99 acre tract situated in Southlake,
Tarrant County, Texas, and being out of the Thomas Easter Survey,
Abstract No. 474, and being part of a tract of land conveyed by
Mildred Banks to Steve D. Pritchett, et ux by deead recorded in
Volume 6774, Page 752, of the Deed Records, Tarrant County, Texas,
which 7.22 acre tract is more particularly described as follows;
BEGINNING at a steel rod for the southwest corner of this tract, by
deed call 807 varas East and 1504.87 feet South of the northwest
corner of the Thomas Easter Survey, said point being the most
southerly northwest corner of Commerce Business Park, an addition
to the city of Southlake, as recorded in Volume 388-214, Page 60,
Plat Records, Tarrant County, Testas;
THENCE North 00 degrees 28 minutes 35 seconds West, 764.21 feet to
a steel rod in the east right-of-way of Crooked Lane and the south
right-of-way of F.M. 1709,
THENCE east along a curve to the left of said right-of-way with a
radius of 1,974.88 feet, an arc distance of 426.30 feet to a point
for a corner;
THENCE departing said right -'of -way, South 01 degrees 38 minutes 53
seconds East, 724.06 feet to a 5/8 inch steel rod for the southeast
corner of said tract and the southwest corner of Lot 2, Block 'A',
Commerce Business Park;
THENCE North 86 degrees 32 minutes 00 seconds West, 435.48 feet to
the point of beginning and containing 7.22 acres.

1. Show the approximate extent of existing tree cover on this site. ,
2. Provide driveway entrance locations in accordance with the Driveway Ordinance No. 634. The two
proposed driveway entrances located on the site which intersect F.M. 1709 do not meet the minimum
spacing requirements as follows:
A. The west driveway centerline is less than 500' from the east R.O.W. line of Crooked
Lane. An approximate 185' spacing is shown.
B. The east driveway centerline is less than 500' from the west R.O.W. line of Commerce
Street. An approximate 400' spacing is shown. Please note that this driveway is
existing. However, the Driveway Ordinance requires that existing driveways must be
brought into compliance when the trip rate is increased by a development.
3. Provide a 5' Bufferyard 'A' along the full extent of the east property line.
Although not required by ordinance, staff would appreciate placing "Case No. ZA 95-116" in the
lower right corner for ease of reference.
The applicant should be aware that any revisions made prior to the next scheduled meeting must be
received at the City by 5:00 n.m. on 3/11/96. If not received by that time, no review will be prepared
until the following submittal schedule. All 17 revised submittals must be folded 6" x 9" and include
one 11"x 17" revised reduction.
Adequacy of parking will be determined upon submittal of the site plan. A summary of square
footage by use will be required to determine parking requirements. Final determination of parking
could affect the requirements for driveway throat depths.

Although no review of required parking or interior landscape is provided at the Concept Plan level,
staff strongly recommends that the lot be evaluated for compliance with the off-street parking and
loading requirements per the Zoning Ordinance 480, Section 35 and 36, and the interior landscape area,
requirements per the Landscape Ordinance No. 544 prior to preparation of any site plans. The
applicant should be aware that a summary of square footage by use will be required to determine
parking requirements. Final determination of parking could affect the requirements for driveway throat
depths. All areas intended for vehicular use must be of an all weather surface material in accordance
with the Zoning Ordinance.
Masonry and building articulation requirements will not be reviewed at the Concept Plan level. This
issue will be addressed upon review of the Site Plans. Please note that vertical and horizontal building
articulation, as well as masonry construction meeting the requirements of Ordinance 480-S, Corridor
Overlay Zone Regulations, will be required on the north, east, and west building facades.
Applicant should be aware Ordinance 480 Section 34.1(n) allows only a maximum of 15% of the total
building square footage for retail uses.
It appears that this property lies within the 65 'LDN' and 75 'LDN D/FW Regional Airport Overlay
Zone which will require construction standards that meet the requirements of the Airport Compatible'
Land Use Zoning Ordinance No. 479.
The applicant should be aware that prior to issuance of a building permit a Final Plat must be
processed and filed in the County Plat Records, and a site plan, landscape plan, irrigation plan, and
building plans, must be submitted for approval and all required fees must be paid. This may include
but not be limited to the following fees: Park Fee, Perimeter Street Fee, Water & Sewer Impact and
Tap Fees, and related Permit Fees.
