CONCURRING IN THE STATE'S DETERMINATION THAT A PORTION OF THE
STATE'S DRAINAGE EASEMENT IS NO LONGER NEEDED AS A ROAD AND THAT
THE DRAINAGE EASEMENT BE QUITCLAIMED IN ACCORDANCE WITH STATE
REGULATIONS.
WHEREAS, the State of Texas acquired and holds in its name a
drainage easement on Farm to Market Highway 1938 as described in
Exhibit A attached hereto and made a part hereof, and
WHEREAS, the State of Texas has determined that said drainage
easement is no longer needed for the construction, maintenance and
operation of Farm to Market Highway 1938, and
WHEREAS, City Staff have studied the public need for said drainage
easement and have determined that said drainage easbment is no
longer needed by the citizens as a road for public transportation
purposes, and is not suitable for conservation, park, recreation
and/or similar purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
1. That the State's right-of-way shown on the attached Exhibit A is
no longer needed by the citizens as a road and is not suitable for
conservation, park, public transportation, recreation or similar
purposes;
2. That the City of Southlake concurs in the State's plan to
dispose of the drainage easement in accordance with the established
laws and regulations of the State of Texas.

BEING 0.432 acre tract of land located in the W. R. EAVES SURVEY,
Abstract No. 500, Tarrant County, Texas, being a portion of Block
1, Southlake Crossing, Phase I Addition to the City of Southlake,
Tarrant County, Texas according to the plat recorded in Cabinet
A, Slide 1613 of the Plat Records of Tarrant County, Texas, being
a portion of a tract of land described in deed to Southlake Joint
Venture, recorded in Volume 7675, Page 1133 of the Deed Records
1 of Tarrant County, Texas, and also being a portion of a Drainage
Easement according to the. deed recorded in Volume 9614, Page 1733
of Deed Records of Tarrant County, Texas and being more
particularly described by metes and bounds as follows:
BEGINNING at a point in the West boundary line of said Block 1,
Southlake Crossing, Phase I Addition and the East right- of -way
line of Davis Boulevard (F.M. Road No. 1938, a variable width
right-of-way), lying N 00°1810011W, 147.02 feet from the Southwest
corner of Lot 1R, Block 1, Southlake Crossing, Phase I Addition;
THENCE N 00°18'00"W along the West boundary line of said Block 1
and the East right-of-way line of said Davis Boulevard (a
variable width right-of-way), 51.90 feet to a point;
THENCE N 44042'00"E, 49.31 feet to a point;
THENCE N 02015118"E, 318.82 feet to a point in the West boundary
line of said Block 1, Southlake Crossing, Phase I
Addition, being the East right-of-way line of said Davis
Boulevard (a variable width right-of-way);
THENCE N 25037149"E, 5.08 feet to a point at the intersection of
the East right-of-way line of said Davis Boulevard (a
variable width right-of-way) and the Southeast right-of-
way line of Southlake Boulevard (F.M. Road No. 1709, a 130
foot wide right-of-way);
