1991-054w City of Southlake, Texas RESOLUTION NO. 91-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, SUSPENDING THE PROPOSED EFFECTIVE DATE OF THE PROPOSED RATE SCHEDULES AND SERVICE REGULATIONS OF TRI -COUNTY ELECTRIC COOPERATIVE, INC., PROVIDING THAT THE RATE SCHEDULES AND SERVICE REGULATIONS OF SAID COMPANY SHALL REMAIN UNCHANGED DURING THE PERIOD OF SUSPENSION, AND PROVIDING FOR NOTICE HEREOF TO SAID COMPANY AND FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, on November 4, 1991, Tri -County Electric Cooperative, Inc., filed with the City Council of the City of Southlake its Application and Statement of Intent, together with its rate -filing package, proposing to change its rate schedules and service regulations within the corporate limits of this municipality, effective on January 1, 1992; and WHEREAS, Tri -County Electric Cooperative, Inc. simultaneously, on November 4, 1991, filed a virtually identical Application and Statement of Intent with the Public Utility Commission of Texas and it is the present intent of the City Council to accept the rate schedules and service regulations of Tri -County Electric Cooperative, Inc. approved and set by the Public Utility Commission of Texas pursuant to said Application and Statement of Intent to be effective from and after the date that the Public Utility Commission of Texas orders said new rate schedules and service regulations effective for Tri -County Electric Cooperative, Inc.; and WHEREAS, it is the desire of the City Council to suspend, pursuant to Section 43(d) of the Public Utility Regulatory Act, the proposed effective date of said proposed changed rate schedules and service regulations for a period of 90 days from January 1, 1992, such suspension being in the public interest; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That the effective date of the proposed changed rate schedules and service regulations of Tri -County Electric Cooperative, Inc. is hereby suspended for a period of 90 days from January 1, 1992; SECTION 2. That the rate schedules and service regulations of Tri -County Electric Cooperative, Inc. within the City limits of Southlake in effect on January 1, 1992, shall continue in force during the period of suspension as provided in Section 1 hereof. 9154.res/ord/rb City of Southlake, Texas Resolution No. 91-54 SECTION 3. That the City Secretary is hereby directed to deliver a copy of this Resolution to Tri -County Electric Cooperative, Inc. promptly after the passage hereof. SECTION 4. That it is hereby officially found and determined that the meeting at which this Resolution is passed is open to the public and that public notice of the time, place and purpose of said meeting was given, all as required by law. SECTION 5. That this Resolution shall be effective upon its passage.
