1991-049RESOLUTION NO. 91-49 A RESOLUTION VACATING AND ABANDONING a 6' wide utility easement within Lot 29, Block 2, Continental Park Estates Addition IN THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS; DECLARING THAT SUCH PROPERTY IS UNNECESSARY FOR USE BY THE PUBLIC; AUTHORIZING THE MAYOR OF THE CITY OF SOUTHLAKE TO EXECUTE A QUITCLAIM DEED RELEASING PUBLIC OWNERSHIP, INTEREST OR CONTROL OF SAID utility easement AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, a 12' wide utility easement has previously been dedicated to the City of Southlake by the owners of Lots 28 and 29, Block 2 of the Continental Park Estates Addition to the City of Southlake, Tarrant County, Texas. WHEREAS, the City Council of the City of Southlake Texas, after careful study and consideration, has determined that the 6' wide portion of the easement located in Lot 29, Block 2 of ' the Continental Park Estates Addition (the "utility easement"), is not being used by, nor useful or convenient to the public in general; therefore, it constitutes a public charge without a corresponding public benefit, and the public would be better served and benefitted by its vacation and abandonment. Said utility easement is more specifically described on the attached exhibits: EXHIBIT A: Metes and Bounds Description EXHIBIT B: Graphic Depiction Further, The attached Exhibit "C" documents the approval of this abandonment by public utility companies. 1- WHEREAS, in order to remove any question as to the continued interest or ownership of the public in said utility easement, the City desires to execute a Quit Claim Deed releasing all title, ownership and control in said easement to the owner or owners of Lot 29, Block 2, Continental Park Estates Addition. 2- EXHIBIT A METES AND BOUNDS DESCRIPTION Being a 6'- wide utility easement -along the -south property line of Lot,29, Block 2 of Continental Park Estates as recorded in Volume 388-98, Pages -23 -and 24, plat records, Tarrant County, Texas, said easement being the north one-half of a 12' wide utility easement being shared by Lots 28 and 29. 3- EXHIBIT B GRAPHIC DEPICTION I-' bG ' - •jC: i Cb ol p r d8• 'i4' . - fit Sd= g..:La:.,g 0 r 1:ws.
