1988-102RESOLUTION NO.(1d A Resolution of the City Council of the City of Southlake, Texas, suspending the proposed November 17, 1988, increase in service rates requested by Lone Star Gas Company for a period of ninety (90) days from and after the date initially projected for implementation by Lone Star Gas Company. WHEREAS, Lone Star Gas Company, a utility service provider, providing natural gas service to the citizens of the City of Southlake, Texas, has filed a Statement of Intent to change residential and commercial rates for all service customers located within the corporate limits of the City of Southlake, as well as in surrounding areas; and, WHEREAS, the Statement of Intent reflects that the proposed new rate structure should become effective and be implemented on November 17, 1988; and WHEREAS, the Gas Utility Regulatory Act, together with other supporting statutes and constitutional provisions requires that the city council of any home rule city shall make a determination as to the reasonableness of the proposed rates under the provisions and subject to the terms and restrictions contained in the Gas Utility Regulatory Act; and WHEREAS, the documents, materials and exhibits attached to the Statement of Intent to change residential and commercial rates as filed by Lone Star Gas Company are extensive, voluminous, complex and require more time for evaluation and analytical assessment than would be provided prior to the originally scheduled date for implementation; and 1 WHEREAS, the City Council of the City of Southlake, in order to discharge its responsibilities to its citizens both present and future, feels that it would be in the best interest of all parties for the City to secure additional time to conduct a more reasoned and thorough evaluation of the necessity for and the impact of the proposed change in residential and commercial gas utility rates; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1 Pursuant to the provisions of the Gas Utility Regulatory Act, the City Council of the City of Southlake, Texas, hereby suspends the implementation of the proposed rate increase as outlined in the Statement of Intent to change residential and commercial rates for a period of ninety (90) days beyond the November 17, 1988 date on which the scheduled rates would otherwise go into effect, in order that the City Council will have sufficient time to study and evaluate the necessity for and the possible impacts of the proposed rate change. SECTION 2 That the City Manager of the City of Southlake is hereby authorized and directed to undertake a preliminary investigation of the proposed change in rates as contained in the Statement of Intent filed by Lone Star Gas, and to recommend to the Council whether consulting experts should be employed or retained for the purpose of preparing a detailed analysis of the proposal. SECTION 3 That the City Attorney of the City of Southlake is hereby authorized and directed to notify Lone Star Gas Company, by and through its authorized representatives, that the proposed increase is hereby suspended for a period of ninety (90) days from the scheduled date of implementation.
