1988-092CITY OF SOUTHLAKE, TEXAS RESOLUTION 88-92 A RESOLUTION OF THE CITY OF SOUTHLAKE, TEXAS APPROVING AND AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH TARRANT COUNTY REGARDING THE FOOD ESTABLISHMENT SURVEILLANCE PROGRAM. PROVIDING AN EFFECTIVE DATE. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. That the City Council hereby approved the renewal agreement for the Food Establishment Surveillance Program, in the form attached hereto as Exhibit "A" and authorize and directs the Mayor to execute and deliver such agreement to Tarrant County on behalf of the city. LeGra City Secretary s Ma'lor KT ---'We sterIfo Im f Southlake STATE OF TEXAS COUNTY OF TARRANT WHEREAS, the governing bodies of the parties herein finds the following agreement in the best interest of the citizens they serve and WHEREAS, Article 3, Section 64 of the Texas Constitution, and Article 4413 (32c) of the Revised Civil Statutes of Texas authorize Counties and Cities in the State of Texas to contract with one another for the performance of various governmental functions a rid services, including those in the area of public health arid welfare; and WHEREAS, Tarrant County and the City of 13uu ILI pursuant to the Constitution and the laws of the State of Texas desire to ake and enter into a contract whereby Tarrant County will make 1 11 vailable to the City of SOUTHLAKE Food Establishment Sur- veillance Program Services for the public health protection of its residents; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: Tarrant County hereinafter called "County," acting Herein by and through Roy English, its duly authorized County Judge as directed by the Commissioners' Court of Tarrant County, and the City of SOUTHLAKE a municipal corporation situated in Tarrant County, Texas, hereinafter called "City," acting herein by arid through JOHNNY H. WESTERHOL,l its duly authorized MAYOR do hereby covenant and agree as follows: County hereby makes available to City for the protection of its isidents Food Establishment Surveillance Program Services through the Tarrant County Health Department 2. The Tarrant County Health Department through its Food Establish- ment Surveillance Program will provide its services to all food establishments located within the corporate limits of said City ming the term of this agreement. The said services shall consist of a food establishment surveillance program, certification of establishments for issuance of health permits, collection of fees, notification to City of violations of health ordinances, documenta- tion of food establishment surveillance program activities within City in a quarterly report, arid, where legally required by ordi- nance, approval of food establishment managers training and certifi- cation. 3. The City agrees maintain during the period of this aqreement, ordinances which: adopt the current Texas Board of Health "Rules on Food Service Sanitation" and "Retail Food Store Sanitation"; desig- nate the Director of the Tarrant County Health Department as Health Authority for the purposes of this agreement; require all food establishments within corporate limits to maintain a valid health permit; adopt health permit fees of $100 annually for each food establishment and $25 for each temporary food establishment; assign to the Tarrant County Health Department the authority to collect health permit fees directly from permit applicants; and, where not precluded by law, require food establishments to have certified managers. 4. The City shall be responsible for enforcement of the. City's Health ordinances. 5. The term of this agreement is for a period of one (1) year com- mencing on October 1, 19 88 and ending on September 30, 19 89 unless either the County or City provides thirty (30) days written notice to the other that an amendment or termination is necessary. AN County is an independent contractor under the terms of this agreement and is not an officer, agent, servant or employee of City. EXECUTED this 18th Tarrant County, Texas.
