1988-091CITY OF SOUTHLAKE, TEXAS RESOLUTION 88-91 A RESOLUTION OF THE CITY OF SOUTHLAKE, TEXAS APPROVING AND AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH TARRANT COUNTY FOR THE COLLECTION OF TAXES IN THE CITY OF SOUTHLAKE, TARRANT AND DENTON COUNTIES. PROVIDING AN EFFECTIVE -DATE. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. That the City Council hereby approved the renewal agreement for the collection of taxes in the City of Southlake, Tarrant and Denton Counties, in the form attached hereto as Exhibit "A" and authorized the directs the Mayor to execute and deliver such agreement to Tarrant County on behalf of the city. LeGra City Secretary i H lIIIIIIIL\\ STATE OF TEXAS X X AGREEMENT OUNTY OF TARRANT X Agreement made this the day , 1988, by and here- inafter referred to as ASSESSOR/COLLECTOR, whose address is 100 E. Weatherford Street, Fort Worth, Tarrant County, Texas, 76196-0301, and the CITY OF SOUTHLAKE hereinafter referred to as CITY, whose address is 667 N. Carroll Avenue, Southlake, Texas 76092. PURPOSE OF AGREEMENT The purpose of this Agreement is to state the terms and conditions under which the ASSESSOR/COLLECTOR will provide collection services for taxes on taxable property within their boundries imposed by the City. NOW THEREFORE, in consideration of the mutual promises herein contained, the parties hereto agree to as follows: I. SERVICES TO BE PERFORMED The ASSESSOR/COLLECTOR agrees to collect the taxes due and owing on taxable property situated in Tarrant and Denton Counties upon which the City has imposed said taxes. The ASSESSOR/COLLECTOR shall perform the said services in the same manner and fashion as Tarrant County collects its own axes due and owing on taxable property situated within its boundaries. The services performed shall include, but not be limited to, receiving information from the respective taxpayers, transmittal of tax statements to taxpayers, rapid deposit mail process, collection of taxes due and owing to the City on taxable property situated in the above setout counties. Additionally, the ASSESSOR/COLLECTOR will provide computer gener- ated lists of those properties assessed a tax, the amount of the tax owed, the amount of tax paid, whether current or delinquent, applicable penalty and interest, and those tax accounts that are unpaid by July and have been referred to the attorneys for collection. II. COMPENSATION In consideration of the services to' be, performed by the ASSESSOR/COLLECTOR, compensation for the services rendered are as follows: 1. A rate of forty cents ($.40) per item or account collected by the ASSESSOR/COLLECTOR. III. TAX RATE REQUIREMENT The City will provide the ASSESSOR/COLLECTOR in writing, their new effective tax rate to be applied for assessing purposes NO later than 2:00 p.m. on the fourth (4th) Friday of September. Under authority of Section 31.01 (h) of the Property Tax Code, any additional cost of printing tax statements because of late reporting of the effective tax rate will be charged to the City. IV. TERM OF AGREEMENT This Agreement shall become effective as of the date hereinabove stated, and shall continue in effect through September 30, 1989, unless sooner terminated and shall terminate without notice at the end of such period unless renewed in writing at least thirty (30) days prior to such expiration. z V. COMPLIANCE WITH APPLICABLE STATUTES, ORDINANCES, AND REGULATIONS In performing the services required by it under this Agreement, the ASSESSOR/COLLECTOR shall comply with all applicable federal and state statutes, and County orders and regulations. If such compliance is impos- sible for reasons beyond its control, the ASSESSOR/COLLECTOR shall immedi- ately notify the City of that fact and the reasons therefor. VI. DEPOSIT OF FUNDS All funds collected by the ASSESSOR/COLLECTOR in performances of the services stated herein for the City shall be mailed to said City. VII. REFUNDS OPTION #2: Due to the daily transmittal of all taxes to said City, all refunds shall be made by the City. VIII. DELINQUENT COLLECTIONS OPTION #2 The ASSESSOR/COLLECTOR shall collect 15% additional fee to compensate the Law Firm contracted by the City to, collect accounts that remain unpaid after July 1. IX. NOTICES Any notices to be given hereunder by either party to'the other may be effected in writing, either by personal delivery or by mail, registered or certified, postage prepaid with return receipt requested. Mailed notic- es shall be addressed to the address of the parties as they appear in the introductory paragraph of this Agreement, but each party may change this address by written notice in accordance with this paragraph. X. MISCELLANEOUS PROVISIONS 1. This instrument contains the entire Agreement between the arties relating to the rights herein granted and obligations herein assumed. Any oral representations or modifications concerning this instru- ment shall be of no force or effect excepting a subsequent modification in writing, signed by the parties. 2. This Agreement shall be constructed under and in accordance with the laws of the State of Texas, an all obligations of the parties created hereunder are performable in Tarrant County, Texas. 3. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective legal representatives and suc- cessors. 4. In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid, illegal, or unen- forceable in any respect, such invalidity, illegality, or unenforceability shall not effect any other provision thereof and this Agreement shall be construed as if such invalid, illegal, or unenforceable provisions had never been contained. 5. This Agreement constitutes the sole and only agreement of the parties hereto and supersedes any prior understandings or written or oral agre(_i,ent between the parties: re-sFecting the within subject matter. 1 Executed at Fort Worth, Tarrant County, Texas, on the day and year first above written.
