1988-025CITY OF SOUTHLAKE, TEXAS RESOLUTION 88-25 A RESOLUTION OF THE CITY OF SOUTHLAKE, TEXAS, AUTHORIZING THE CITY MANAGER TO SATISFY THE CONDITIONS SET FORTH BY THE CITY OF COLLEYVILLE FOR THE TEMPORARY USE OF THE COLLEYVILLE WASTE WATER INTERCEPTOR LINE BY THE NEW CARROLL ELEMENTARY SCHOOL PENDING COMPLETION. OF THE TRINITY RIVER AUTHORITY (TRA) BIG BEAR INTERCEPTOR LINE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. That the City Manager is authorized and hereby directed to obtain a irrevocable letter of credit in the amount of $50,000. which is acceptable and payable to the City of Colleyville in the event the City of Southlake fails to pay the fees due in a timely manner and/or exceeds the granted line capacity authorized by the agreement. Section 2. That the City Manager execute a service agreement providing for waste water service of the new Carroll Elementary School for a period of approximately one (1) year or until the Big Bear Interceptor line is placed in operation. Carroll Elementary School capacity will be measured using water consumption of the school. The measurement to be certified by the City Manager and submitted to the City of Colleyville on a monthly basis. Latta, Jr. City Manager City of Southlake 667 North Carroll Avenue Southlake, Texas 76092 Re: Carroll Elementary Sewer Connection Dear Lloyd, The City Council approved our recommendation regarding revising the conditional requirements associated with the grant of line capacity to the Carroll I.S.D. as an assignment of line capacity now owned by Joe Wright, successor to C.S. Sparger. The following will be required to be provided the City of Colleyville: 1) An irrevocable letter of credit, acceptable and payable to the City of Colleyville, in the amount of $50,000. This letter of credit will be in lieu of the bond requirements specified in the assignment clause (page 5) of the original agreement with C.S. Sparger and wife. This letter of credit will serve as surety to the City of Colleyville in the event that a) fees due become deficient and/or b) granted line capacity assigned exceeds that authorized by the agreement. We reserve the option to verify water consumption records to determine daily effluent volumes from the school. Should daily effluent exceed the granted amount of 10,000 GPD we request that additional line capacity be obtained from Joe Wright's original line capacity of 1.9 million GPD. 2) An annual line charge fee of $500 payable in advance for the remainder of the year is required to be remitted to the P. 0. THAT the agenda decisions approved by Council action under Old Business this date and not otherwise adopted by Ordinance and 10 separate Resolution, as follows are hereby adopted: 1. THAT the Combination Plat of the Grubbs Addition is approved, 11 Case No. Z-87-651; 12 2. THAT the original authorization to allow the Southlake/Carroll j I.S.D. to have access to the Colleyville Sewer be modified 13 to accept a letter of credit in the amount of $50,000 in lieu of a bond and to charge a $500 transportation fee each January; 14 3. IiLeVadeJohnson City Secretary EXTRACT FROM THE MINUTES OF THE CITY COUNCIL OF COLLEYVILLE, TEXAS The City Council of the City of Colleyville, Tarrant County, Texas, convened in regular session on the 7th day of March, 1988, at 7:30 p.m., with the following persons present: Mayor: Buck Hubbard Councilpersons: Doug Blemings Chris Hawkins Suzie Grundy Charles Gore Jack Burke A quorum being present, came on to item 10 of Old Business: "Discussion and Consideration of Authorization Granted for the Temporary Transfer of Line Capacity from Joe Wright to the Carroll Independent School District to Provide Sanitary Service to the new Carroll Elementary School". On motion made by Councilperson Burke to the accept the staff's recommendation of an acceptable irrevocable letter of credit in the amount of $50,000 payable to the City of Colleyville for failure to honor the Sparger Agreement as successors/assigns and an annual line charge (transportation fee for use of line) in the amount of $500 payable now and each subsequent January and seconded by Councilperson Hawkins which carried four (4) ayes to one (1) nay by Suzie Grundy, the City Council voted the passage of the modification of the original authorization to Southlake/Carroll I.S.D. and to record same at length in these minutes.
