RESOLUTION NO.
A RESOLUTION OF THE CITY OF SOUTHLAKE,
TEXAS, ACCEPTING A PETITION OF PROPERTY
OWNERS FOR ANNEXATION OF PROPERTY INTO THE
CITY OF SOUTHLAKE, TEXAS; INSTRUCTING CITY
STAFF TO TAKE NECESSARY ACTION TO COMMENCE
CONSIDERATION OF THE ANNEXATION; AUTHORIZING
THE CITY ADMINISTRATION AND CITY ATTORNEY TO
INSTITUTE NECESSARY LEGAL ACTIONS TO
PRESERVE AND PROTECT THE STATUS QUO OF THE
EXISTING LAND USE OF THE PROPERTY PROPROSED
TO BE ANNEXED; DECLARING AN EFFECTIVE DATE
WHEREAS, the City Council has been presented with a
petition for annexation of certain property into the City of
Southlake, Texas (the "City"), which petition is attached
hereto as Exhibit A (hereafter referred to as the "Petition");
and
WHEREAS, the City Council desires to accept the Petition,
provided it meets all requirements of law, and to instruct City
staff to proceed with the necessary actions for commencement of
the annexation proceedings; and
WHEREAS, the petitioners have requested in the Petition
that the City take action to preserve and protect the status
quo of the existing land -use of the property that is being
petitioned for annexation, and to prohibit any new or expanded
construction, development or land -use that is inconsistent with
the land -use plan of the City; and
WHEREAS, it is the intention of the City Council to
hereby instruct the City Administration and City Attorney to
analyze the City's land -use plan as projected into the area
being petitioned for annexation and to institute such legal
action as is necessary to preserve and protect the status quo
of the land -use as requested in the Petition.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, Texas:
SECTION 1. All of the above premises are found to be
true and correct and are incorporated into the body of this
resolution as if copied in their entirety.
SECTION 2. The City Council hereby accepts the
Petition for annexation of certain property into the City of
Southlake, Texas, provided it meets all requirements of law,
and hereby instructs City staff to proceed with all necessary
actions for commencement of the annexation proceedings.
SECTION 3. The City Council hereby instructs and
directs the City Administration and City Attorney to analyze
and review the City's land -use plan as projected into the area
that is being petitioned for annexation, and to institute any
necessary legal actions to preserve and protect the status quo
of the existing land -use and to prohibit any new or expanded
construction, development or land -use that is inconsistent with
the land -use plan of the City, including the institution of any
necessary legal action to prohibit the approval and
construction of a heliport.
SECTION 4. This Resolution shall be in full force and
effect from and after its passage.
