A RESOLUTION OF THE CITY OF SOUTHLAKE, TEXAS
ESTABLISHING A NEW DATE FOR GENERAL CITY
COUNCIL ELECTIONS AND FOR GENERAL CITY
COUNCIL RUNOFF ELECTIONS; ADOPTING THE USE
OF AN ELECTRONIC VOTING SYSTEM FOR ALL CITY
ELECTIONS; AUTHORIZING THE CITY ATTORNEY TO
MAKE SUBMISSIONS TO THE U.S. JUSTICE
DEPARTMENT FOR PRE -CLEARANCE APPROVAL;
REPEALING INCONSISTENT RESOLUTIONS;
DECLARING AN EFFECTIVE DATE
WHEREAS, House Bill 28 of the Second Called Session of
the 70th Texas Legislature ("H.B. 28") has amended the Texas
Election Code pertaining to Uniform Election Dates and runoff
elections; and
WHEREAS, Sec. 41.001 of the Texas Election Code has been
amended by H.B. 28 to provide for the holding of general city
elections on the first Saturday in May; and
WHEREAS, Sec. 2.025 of the Texas Election Code has been
amended by H.B. 28 to provide for the holding of May runoff
elections on either the last, or next to last, Saturday in May;
and
WHEREAS, the City has previously held its General City
Council elections and runoff elections in April; and
WHEREAS, the City desires to conform its practices with
State law; and
WHEREAS, the City additionally desires to discontinue the
use of paper ballots for voting in future general or special
City elections, and to adopt the use of an electronic voting
system; provided, however, that paper ballots would continue to
be used for absentee voting; and
WHEREAS, the changes from prior practices may require
pre -clearance under the Federal Voting Rights Act;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, Texas:
SECTION 1. That, from and after the effective date of
this Resolution, general City Council elections shall be held
on the first Saturday in May;

SECTION 2. That, from and after the effective date of
this Resolution, general City Council runoff elections, if
needed, shall be held on the next to last Saturday in May;
SECTION 3. That, from and after the effective date of
this Resolution, an electronic voting system shall be used for
all general or special City elections in lieu of the present
system of using paper ballots, provided an electronic voting
system is available for use by the City, and except that paper
ballots shall continue to be used for absentee voting.
SECTION 4. That the City Attorney is authorized to make
such submissions as are necessary to the United States Justice
Department to seek pre -clearance approval for the new election
and runoff election dates;
SECTION 5. That the actions herein contemplated are
taken to comply with the laws of the State of Texas and the
Federal Voting Rights Act;
SECTION 6. That any provision of any resolution of the
City of Southlake, Texas that is inconsistent with this
Resolution is repealed to the extent of such inconsistency.
SECTION 7. That this Resolution shall be in full force
and effect from and after its passage.
