OJ -.2--) A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF SOUTHLAKE, TEXAS AND THE TARRANT COUNTY HEALTH DEPARTMENT (THE "DEPARTMENT") WHEREBY THE DEPARTMENT WILL PROVIDE CERTAIN SERVICES TO THE CITY THROUGH ITS FOOD ESTABLISHMENT SURVEILLANCE PROGRAM. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNTIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. That the agreement between the City of Southlake, Texas and the Tarrant County Health Department is hereby approved in the substantially final form attached hereto as Exhibit A and incorporated herein by reference (the Agreement"), with such insubstantial changes as may be approved by the City Attorney and City Manager. Section 2. That the City Manager is hereby authorized to execute and the City Secretary is hereby authorized to attest the Agreement with such insubstantial changes as have been approved by the City Attorney and the City Manager. SOUTHLAKE ON THE %% DAY OF ATTEST: Zzk,t-,) ity Secretary, City of Southlake APPROVED AS TO FORM: City Attorney, City of Southlake 0 1 9 1 L/ 1 0 ITY COUNCIL OF THE CITY OF 1988. r r, City of Southla EXHIBIT A STATE OF TEXAS COUNTY OF TARRANT WHEREAS, the governing bodies of the parties herein finds the following agreement in the hest interest of the citizens they serve and WI1L•'I<L•:AS, Artic:lf: 3, Secticnn 64 of the Texas Constitution, and Article 4413 (32c) of the Revised Civil Statutes of Texas authorize Counties and Cities in the State of Texas to contract with one another for the performance of various governmental functions and services, including those in the area of public health and welfare; and WHEREAS, Tarrant County and the City of pursuant to the Constitution and the laws of the State of Texas desire to make and enter into a contract whereby Tarrant County will mzke available to the City of Food Establishment Sur- veillance Program Services for the public health protection of its residents; VOW, THEREFORE, KNO14 ALI. MEN BY THESE PRESENTS: Tarrant County hereinafter called "County," acting herein by and through Roy English, its duly authorized County Judge as directed by the Commissioners' Court of Tarrant County, and the City of a municipal corporation situated in Tarrant County, Texas, hereinafter called "City," acting herein by and through its duly authorized , do hereby covenant and agree as follows: 1. County hereby makes available to City for the protection of its residents Food Establishment Surveillance Program Services through the Tarrant County Health Department . 2. The Tarrant County Health Department through its Food Establish- ment Surveillance Program will provide its services to all food establishments located within the corporate limits of said City during the term of this agreement. The said services shall consist of a food establishment surveillance program, certification of estal,lishments for issuance of health permits, collection of fees, notification to City of violations of health ordinances, documenta- tion of fooci establishment surveillance program activities within City in a quarterly report, and, where legally required by ordi- nance, approval of food establishment managers training and certifi- cation. 3. The City agrees to provide the Tarrant County Health Department, within 90 days of the commencement of this agreement, proof of the existence of whatever ordinances may be necessary to: adopt the current Texas Board of Health "Rules on Food Service Sanitation" and Retail rood Store Sanitation"; to designate the Director of the Tarrant County Health Department as Health Authority for the pur- poses of this agreement; to require all food establishments within corporate limits to maintain a valid health permit; to adopt health permit fees of L$10D annually for each food establishment andL/_§2_5jfor each temporary food establishment; to assign to the Tarrant County Health Department the authority to collect health permit fees directly from permit applicants; and, where not precluded by law, to require food establishments to have certified managers. 4. The City shall be responsible for enforcement of the City's health ordinances. 5. The term of this agreement is for a period of one (1) year com- mencing on October 1, 1987 and ending on September 30, 1988, unless either the County or City provides thirty (30) days written notice to the other that an amendment or termination is necessary. 6. County is an independent contractor under the terms of this agreement and is not an officer, agent, servant or employee of City. EXECUTED this day of , 1987 in Tarrant County, Texas.
