RESOLUTION 87-85
WHEREAS, the City of Southlake is engaged in pending
litigation with the Federal Aviation Administration (FAA)
and Dallas -Fort Worth Regional Airport (DFW) over the
opening and use of Runway 13R/31L;
WHEREAS, aircraft take -offs and landings on Runway
13R/31L are currently not confined to a specific
identified flight path, aircraft are not required to use
noise abatement procedures when taking off, and runway
utilization relative to other DPW runways has increased
over levels previously identified;
WHEREAS, this runway utilization is significantly
different than either DFW's 1971 Environmental Impact
Statement (EIS) or the 1983 reevaluation of the EIS;
WHEREAS, the City of Southlake is convinced that the
environmental impact, and the impact upon the citizens of
Southlake, of current unrestricted use of Runway 13R/31L
is significantly different than that predicted by earlier
environmental studies, while DFW and FAA believe that the
impact of current and planned unrestricted use is within
the range of environmental consequences predicted by
prior studies;
WHEREAS, FAA and DFW have offered to discuss
settlement of pending litigation by undertaking a study
of the noise levels that might be anticipated from
current and anticipated unrestricted use of Runway
13R/31L and have further committed to undertake steps to
mitigate any significant adverse impact of such
operations, to the extent they exceed or are different
from those identified by prior EIS;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Southlake that:
The City expresses its willingness to undertake
negotiation of a settlement of pending litigation in
general accordance with the FAA proposal;
Any settlement agreement provide reasonable
assurances of the study's objectivity and accuracy;
Any settlement agreement provide for disclosure of
results of DFW noise monitoring studies in Southlake, and
for consideration and utilization of those results in
connection with the study that will be undertaken;
The City hereby expresses its willingness io open
commrnnicat:ions with DFW in an attempt to establish a
t working relationship that will allow DFW to make use of
Runway 13R/31L while insuring that easily avoidable
adverse impacts of aircraft noise in Southlake are
avoided and that the City in provided sufficient

certainty with regard to future runway use that it will
be able to plan and manage future development in
Southlake to achieve maximum compatible development.
