1987-083r RESOLUTION NO. 87-83 THE STATE OF TEXAS § 6 ' COUNTY OF TARRANT THIS CONTRACT AND AGREEMENT made and entered into by and between the Tarrant County Rural Fire Prevention District 01, acting by and through its Board of Fire Commissioners, hereinafter referred to as DISTRICT and the town i or city of Southlake, Texas, a Municipal Corporation, acting by and through its City Council, hereinafter referred to as CITY: WITNESSETH: The above named CITY has a volunteer fire department recognized by the Insurance Commission of the State of Texas or a full-time professional fire department, and has, by an order or resolution of its governing body, been authorized to enter into an Agreement with DISTRICT for providing for the use of the fire trucks and other fire fighting equipment of the said CITY for the purpose of fire protection to real and personal property located outside the boundaries of said CITY and within such distance as such fire department may be reasonably expected to reach and render service in case of fire, said area being that outlined in red on the attached Exhibit "B." The CITY hereby agrees to provide such services. DISTRICT has appropriated a sum to be paid and distributed to Fire Departments for such services. CITY and DISTRICT hereby agree that for and in consideration of the monies to be paid by DISTRICT to CITY, the CITY shall provide, through its fire department, fire protection services to the areas i hereinabove expressed. DISTRICT agrees to pay to DEPARTMENT an amount based upon DEPARTMENT'S proportionate per run share determined by allocating the sum of Two Hundred Eighty -Five Thousand (5285,000.00) Dollars, which share shall be determined by dividing said sum by the total points per service run as established by the 1487 Rules and Regulations adopted by DISTRICT, a copy of which is attached hereto and marked as EXHIBIT A, for all service runs made in the unincorporated area of Tarrant County and multiplying that quotient by the total number of points accrued by DEPARTMENT during the service year. It is understood and agreed by the parties hereto that reports of such service calls must be received no later than the 15th of the month following i the month in which a service run was made by DEPARTMENT by DISTRICT at its I 1 s — - J,-;, ; offices at 2750 Premier Street, Fort Worth, Texas in order to be eligible for payment and the parties further agree that the determination of DISTRICT shall t be final with regard to the allocation of service run points. It is understood and agreed by the parties hereto that the total sum paid by DISTRICT for fire protection and ambulance service to the unincorporated areas of the County shall in no event exceed the amount budgeted 1 by DISTRICT for such services which sum, for the year 1987, is currently estimated to be Three Hundred Fifteen Thousand ($315,000.00) Dollars and that DISTRICT is under no obligation with respect to providing fire fighting equipment or ambulance vehicles or supplies. or any other expenses incidental to the carrying out of this Contract, and shall have no right, title or interest in and to the said vehicles and equipment belonging to said DEPARTMENT. For purposes of determining the payments due hereunder, this Contract shall be in full force and effect for and during the period beginning December 1, 1986 and ending November 30, 1987, that being the period for which payment shall he made from the 1987 DISTRICT funds. For response purposes this Agreement shall remain in force until the 1988 DISTRICT budget is approved by the Fire Commissioners and a new Contract is initiated retroactive to December 1, 1987. The funds to be paid by DISTRICT for use of the fire fighting and emergency ambulance equipment and related services in DEPARTMENT'S assigned area shall be paid out of the general fund of the DISTRICT. and shall be paid to the above named DEPARTMENT as hereinabove provided. Whenever the DEPARTMENT is responding to a call outside the normal a jurisdictional limits of the FIRE DEPARTMENT it shall operate under the Fire Code which is in effect within the city limits of such city or fire department primarily responsible for service to the area being served by DEPARTMENT. Any fire investigators or other personnel who respond from DISTRICT to a fire or emergency scene which is under the control of DEPARTMENT shall be governed by the Fire Code of the DEPARTMENT within whose limits the FIRE DEPARTMENT normally operates. DEPARTMENT personnel agree to fully cooperate with DISTRICT personnel. Runs as received by the dispatcher must be of an emergency nature to qualify for payment. Z. Dispatchers should be familiar with their territory. If a dispatcher receives a call for another district, the dispatcher should inform the caller of the proper department, then make a reasonable attempt to notify the proper department before toning out, but has the responsibility of responding if unable to raise the proper department. 3. Each run report should have STREET ADDRESS, distance and direction of nearest cross street, and MAPSOD Map coordinates. 4. There will be no pay for AUICMATIC Mutual Aid. If.you and your neighbor have an automatic mutual aid agreement on certain locations, please do not ask for pay unless there actually was a need for mutual aid. The Fire District will pay mutual aid ONLY to departments who have been called by the primary responding department. The number of points given to a mutual aid department will not exceed those received by the primary responding department. If the primary department does not respond one fully manned apparatus to the scene of a call, the mutual aid department will receive primary response points. 5. Run reports MUST be received by the 15th of the following month. Any reports received after the 15th WILL NOT BE PAID. 6. We have been asked to verify calls just to keep everyone honest, so be forewarned that spot checks of random reports will be performed. POINT VALUE FOR VARIOUS SIUMMONS FIRE POINT VALUE A.
