1987-061RESOLUTION 87-61 A RESOLUTION APPROVING IN PRINCIPLE PARTICIPATION BY THE CITY AND BY THE CITY POLICE DEPARTMENT IN MUTUAL AID LAW ENFORCEMENT TASK FORCE AGREEMENTS; AUTHORIZING THE CHIEF OF POLICE TO SEEK OUT AND NEGOTIATE WITH OTHER POLITICAL SUBDIVISIONS FOR THE PURPOSE OF ENTERING SUCH AGREEMENTS; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Vernon's Annotated Revised Civil Statutes of the State of Texas, Article 999b authorizes the governing body of a municipality to enter into agreements with neighboring municipalities, airports, and contiguous counties to form mutual aid law enforcement task force cooperation; and WHEREAS, it may be necessary from time to time to provide additional law enforcement officers to assist the Southlake Police Department to protect health, life, and property against riot, unlawful assembly accompanied by the use of force and violence, threat of concealed explosives, and during times of natural disaster or man-made calamity; and WHEREAS, Southlake Police Department Officers when performing police duties outside the territorial limits of the City of Southlake pursuant to Mutual Aid Law Enforcement Task Force Agreements shall be entitled to the same wage, salary, compensation and other benefits as if the service had been rendered within the city limits of the City of Southlake, Texas; and WHEREAS, all contracting parties to any Mutual Aid Law Enforcement Task Force Agreement will agree to waive their rights to request reimbursement from other participating parties and law enforcement agencies for the services performed; and WHEREAS, once in the other jurisdiciton, the responding officers would be under the command of the chief law enforcement officer of that jurisdiction until the responding entity, in its discretion, elects to withdraw from such service. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: I. Thatl the City Council of the City of Southlake approves in principle the City's participation in Mutual Aid Law Enforcement Task Force Agreements to be prepared in accordance with the provisions of Article 999b, Vernon's Annotated Texas Civil Statutes. II. That the City Council of the City of Southlake hereby authorizes the Chief of Police of the City of Southlake to seek out and negotiate with other political subdivisions for the purpose of entering into Mutual Aid Law Enforcement Task Agreements, which Agreements shall be presented individually to the City Council for approval as negotiated prior to their adoption. If any section, subsection, sentence, clause or phrase of this Resolution shall for any reason be held to be invalid, such decision shall not affect the validity of the remaining portions of this Resolution. IV.
