1987-024RESOLUTION 87-24 RESOLUTION AND ORDER CANVASSING ELECTION RETURNS RESOLUTION AND ORDER CANVASSING RETURNS AND DECLAR- ING RESULTS OF SPECIAL ELECTION HELD IN THE CITY OF SOUTHLAKE ON APRIL 4th, 1987, ON QUESTION OF ADOPTION OF CHARTER FRAMED BY CHARTER COMMISSION AS HOME -RULE CHARTER OF SAID CITY: AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. WHEREAS, there was held in the City of Southlake, Texas, on the 4th day of April, 1987, an election at which was submitted to the duly qualified resident electors of said City, for their action thereupon, the following proposition: SHALL THE CHARTER FRAMED BY THE CHARTER COMMISSION BE APPROVED AND ADOPTED AS THE HOME -RULE CHARTER OF OF THE CITY OF SOUTHLAKE TEXAS? and, WHEREAS, there were cast at said election 967 votes, of which number were cast: FOR" ....................... 812 votes AGAINST" ................... 131 votes as shown in the official election returns heretofore law- fully sumbitted to the City Council of said City and filed with the City Secretary; and, WHEREAS, only duly qualified resident electors of said City voted at said election, and said election was called and held in strict conformity with the laws of the State of Texas, Therefore, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. That the election described in the preamble to this resolution and order was duly called and notice thereof given in accordance with law; that said election was held in the manner required by law; that only duly qualified resident electors of the City of Southlake voted at said election; that due returns of said election have been made by the proper officers; that said election has resulted favorably to the proposition: SHALL THE CHARTER FRAMED BY THE CHARTER COMMISSION BE APPROVED AND ADOPTED AS THE HOME -RULE CHARTER OF THE CITY OF SOUTHLAKE TEXAS?: and that a majority of the qualified voters of said city, voting at said election, have voted in favor of approving and adopting the Charter framed by the Charter Commission as the Home -Rule Charter of said City of Southlake. Section 2. That the City Council of the City of Southlake, Texas, hereby officially and affirmatively declared that said Charter has been property and lawfully adopted, and is now the Home -Rule Charter of said City. Section 3. That the Mayor is hereby authorized and directed to certify to the Secretary of State of the State of Texas an authenticated copy of such Charter, under the official seal of the City, showing the approval thereof by the qualified voters of said City; and the City Secretary is hereby authorized and directed to record said Charter at length upon the records of said City, in a separate book kept in his office for such purpose. Section 4. That, pursuant to the provisions of Section 1 of Article XI of said Charter, the Council shall, as soon as possible, put such Charter into effect by ordinance or resolution; provided, however, that said Charter shall go into effect no later than tht, _ 7 , 1987.
