2020-06-11 ZBA Minutes C Y SOUTH LAKE TEXAS ZONING BOARD OF ADJUSTMENT MEETING: June 11, 2020 LOCATION: 1400 Main Street, Southlake, Texas Regular Session-City Council Chambers Members Present: Board members: Chair Jeff Medici, Vice Chair David Treichler Michael Quinones- Place 1, Akash Shah- Alternate 1, Robert Kemins- Alternate 2, Austin Reynolds- Alternate 3. Members Absent: Brett Nickel- Place 4 and Heather King-Alternate 4 Staff Present: Richard Schell, Principal Planner and Miranda Picklesimer, Board Secretary REGULAR SESSION: 1. Call to Order: Chair Medici called the Regular Session to order at 6:34 P.M. 2. Executive Session: No executive session was held. 3. Approval of the Minutes: Chair Medici opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on May 28, 2020. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on May 28, 2020. Motion: Kemins Second: Reynolds Ayes: Medici, Treichler, Quinones, Shah, Kemins, and Reynolds Nays: None Abstain: None Vote: 6-0-0 Motion: Approved 4. Administrative Comments: Richard Schell, Principal Planner, announced that there are no scheduled meetings for the month of July and if the June 25, 2020 meeting is not required, then the next meeting is scheduled for August 13, 2020. Planner Schell also announced the upcoming City Council appointments for Boards and Commissions and thanked the members who will not be returning for their service. Agenda Item No. 5 ZBA20-0006- Variance to Zoning Ordinance No. 480, as amended, Section 9.5.b requiring a front yard of not less than 40', Section 9.5.c requiring a side yard of not less than 25' and Section 9.5.e requiring the maximum lot coverage to not exceed 10% of the lot area and a Special Exception Use per Ord. No. 480, as amended, Section 44.12(6) for a reduction in the required setback from property lines for a residential accessory building on property described as Lot 2C1, R.P. Estes Subdivision, being a portion of Lot 2, R. P. Estes Subdivision, Tarrant County, Texas, and located at 2350 Crawford Ct., Southlake, Tarrant Zoning Board of Adjustment Meeting Minutes—June 11, 2020 Page 1 of 3 County, Texas. Planner Schell presented details of the case with a slide show presentation to the Board. The applicant on behalf of Danny Hernandez, Santos T. Martinez, is requesting approval of a Variance to Ord. No. 480, as amended, Section 9.5.b requiring a front yard of not less than 40', Section 9.5.c requiring a side yard of not less than 25' and Section 9.5.e requiring a maximum lot coverage for all buildings and structures to not exceed 10% of the lot area to allow an approximately 2,085 square foot principal residence to be constructed with a front setback of approximately 35' and a side setback of approximately 7.5', and to allow the combined lot coverage for the principal residence and an approximately 797 square foot garage to be approximately 12.88% of the lot area. Also requested is approval of a Special Exception Use to allow the approximately 797 square foot garage to be constructed approximately 0.8' from the side property line. The minimum required side yard setback for the garage is the same as for the principal residence, which is 25' as noted above. Site photos in Attachment `D' of this report show that the foundation for the house has been poured and the garage has been constructed without obtaining the required building permits. A stop work order has been placed on the property. Chair Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Santos T. Martinez, 12 Tanager Terrace, Angel Fire, NM, the applicant's representative, once sworn in, presented testimony, and answered questions from the Board. Danny Hernandez, 1905 McMillian Ave., Dallas, TX, the owner, once sworn in, presented testimony, and answered questions from the Board. A motion was made to approve case ZBA20-0006 with the setbacks presented at the meeting. (The plans presented at the meeting showed a front yard setback of 35', side yard setbacks of 15' for the house and garage and a lot coverage of approximately 12.75%.)
