Plat Revision Lots 3R3R1, 3R3R2 Block 1, Steward Addition (551 & 561 E Dove Rd)
Ken,
I'd like to submit a plat response to be considered by City Council on March 2, 2021.
This Plat Revision submittal is to subdivide the lot into two lots. The reason for the request is that the applicant
intends to sell Lot 3R3R2 for the development of one single family lot. The property was improperly subdivided before
we purchased it and our request is to complete the subdivision as intended by the original seller, Mr. F.L. Bailey on
March 2, 1999.
By this letter we request a variance for the following with respect to the above case number:
a. Subdivision Ordinance No. 483, section 8.01 A requiring that every lot shall front a public or private street.
The driveway to access the new lot being 12 feet wide will be within the 25 feet wide roadway easement.
b. Subdivision Ordinance No. 483, section 5.06 requiring sidewalks along both sides of all public and private
streets.
The Private Drive is an existing road already dedicated for public use.
Our application makes Steward Addition better for everyone on the private drive.
We provide an additional turnaround on 3R3R2, dedicated to the Public, for emergency and delivery vehicles that
can't be blocked off by the lot owner. The existing turnaround on the NE corner of our property 3R3R1 is
sufficient for emergency and delivery vehicles, as already reviewed by Deputy Fire Chief / Fire Marshall Clements.
We offer a solution to relieve the existing trash and mail congestion through a pad fronting Dove Rd (already
approved by the owner of House 465 and reviewed with the City).
We grant a sewer easement along our Northern property line to Houses 535 and 575.
We offer to replace the water line from Dove Road to House 535. The current line is PVC, shallow -buried,
undersized and subject to breakage.
We look forward to a favorable response to our Plat Revision and request for the above variances.

The original plat of Steward Estates is filed in Volume 388-159, Page 40;
and the re -plat is filed in Cabinet A, Slide 4814 in the PRTCT.
1) F.L. Bailey conveyed unto Milo Choate, all of Lot 3R3, Block 1 of
Steward Addition on 3-2-1999. The deed is recorded in the PRTCT at
Doc# D199052746.
***NOTE*** - It appears that the confusion of the record
concerning the un -platted split of Lot 3113 may have begun during
the Choate's ownership. The Choates executed a Deed of Trust in
favor of F.L. Bailey in the amount of $36k on the same date in
which they closed on Lot 3R3. It appears the Choates began to
plan for the construction of a new home on the northern —1.00-
1.09 acre portion of Lot 3133. It appears that the bank providing
the construction loan likely wanted the home site to be free and
clear of any liens. It appears that F.L. Bailey executed a Partial
Release of Lien, releasing the northern —1.00-1.09 portion of Lot
3R3 from the prior Deed of Trust, but it was subject a Springing
Contingent Easement executed by the Choates to allow F.L. Bailey
access to the southern portion of Lot 3R3 in the event of a
foreclosure. It appears that the Choates were able to secure their
construction loan on the northern portion of Lot 3R3 and the new
home was constructed. It then appears that that upon the
completion of the new home, the Choates rolled their
construction loan into a traditional loan and when doing so, only
the northern portion of Lot 3R3 was described in the new loan. It
then appears that the Choates paid off their first Deed of Trust in
favor F.L. Bailey and F.L. Bailey executed a full release of lien.
2) Milo Choate and Spouse, Betsy Choate, conveyed unto Kevin J. Land
and Spouse, Melissa M. Land, all of Lot 3113, Block 1 of Steward Addition
on 6-25-2004, however, was effective as of 7-2-2001. The deeds are
recorded in the PRTCT at Doc# D204219091 & Doc# D207413916.
3) Kevin J. Land and spouse, Melissa M. Land, conveyed unto Jerry Don
Mills, a married man, the northern —1.00 acre tract of Lot 3113, Block 1
of Steward Addition on 4-11-2008. The deed is recorded in the PRTCT at
Doc# D208141477 & Doc# D209098635.
***NOTE*** - It appears that this conveyance was supposed to
cover Lot 3113 in its entirety, however, it appears that confusion of
the proper legal description resulted in only the norther —1.00-
1.09 acre tract being conveyed.
4) Jerry D. Mills conveyed unto Kimberly Ann Mills, pursuant to Cause
No. 324-439096-08, styled "in the Matter of the Marriage of Jerry D.
Mills and Kimberly Ann Mills, " entered in 324t" of Tarrant County,
Texas, the northern —1.00 acre tract of Lot 3113, Block 1 Steward
Addition on 10-9-2008. The deed is recorded in the PRTCT at Doc#
D208399385.
***NOTE*** - It appears that Jerry D. Mills and Kimberly Ann
Mills divorced in 2008 and that the court was under the
impression that Jerry D. Mills was the record owner of all of Lot
3113 at the time of the divorce. It appears that the court likely
used the legal descriptions from the Choate era Construction Loan
and Springing Contingent Easement to divide the property
between Jerry D. Mills and Kimberly Ann Mills.
5) Jerry D. Mills conveyed unto the Mills Children's Trust, pursuant to
Cause No. 324-439096-08, styled "In the Matter of the Marriage of
Jerry D. Mills and Kimberly Ann Mills, " entered in 324th of Tarrant
County, Texas, the southern —1.282 acre tract of Lot 3R3, Block 1
Steward Addition on 10-9-2008. The deed is recorded in the PRTCT at
Doc# D208399386.
***NOTE*** - It appears that Jerry D. Mills conveyed his interests
in the southern portion of Lot 3113 in which he received pursuant
to the property division in his divorce of Kimberly Ann Mills
although at this time, Jerry D. Mills had no actual record
ownership.
6) *AFTER ACQUIRED TITLE* Kevin J. Land and Spouse, Melissa M.
Land, conveyed unto Jerry Don Mills, a married man, the southern
1.282 acre tract of Lot 3113, Block 1 Steward Addition on 4-27-2009.
The deed is recorded in the PRTCT at Doc# D209145848.
***NOTE*** - This conveyance cured title on the conveyance
listed on line item #5
7) Kimberly Ann Mills, a single person; and Mason Kelley, Successor
Trustee of the Mills Children's Trust, conveyed unto Richard E. Bollar
and Leesa Stephens Bollar, Tract I, being the northern —1.00 acre
portion of Lot 3R3, Block 1 Steward Addition and Tract II being the
southern —1.282 acre portion of Lot 3R3, Block 1 Steward Addition. The
