Property Situation:
The property is located at 2970 Burney Lane.
Development Details:
The Sage Group is proposing a residential development, Burney Estates (The Conservation), an eight
(8) large lot, luxury home development on 13.2 acres adjacent to the Corps of Engineers property on
Grapevine Lake. The property consists of two properties, one platted lot located on Burney Lane and
one land -locked property located west of Burney Lane. The property will be accessed through a 40 ft.
access easement with a 25 ft. pavement from back -of -curb to back -of -curb from Burney Lane. The
properties are zoned SF-1A and AG and will need to be rezoned to SF-1A for the development. The
average lot size is over 71,000 square feet. The rear property lines of Lots 1-5 show the 572-contour
line of the flowage easement for the lake. There will be a wildlife and pedestrian access easement on
the property to allow wildlife to access the neighborhood and residents to access the open space of
the Corps property. The development will not be fenced or gated from Burney Lane. The drainage
from the property flow towards the lake and the applicant will address the drainage under the street to
allow the water to flow freely to the lake. The entrance to the development will be understated and
have a wrought iron fence along Burney Lane and along the south drive edged with evergreen plant
materials for the neighbor to the south. Applicant wants to maintain as many trees on the lot and will
provide a tree conservation plan for preservation of the trees. The development will be a R-PUD
Residential Planned Unit Development with SF-1A underlying regulations. Lot 7 will not be allowed to
have a rear fence to allow wildlife to access the adjacent properties.

2. Concerns with the development not being in line with the current neighborhood with the country
feel, the proximity to the lake and development impact, and breaking up the lots in their
neighborhood.
Lots will be close to 1 '/2 acre and fall within the low density residential and will increase
property values.
3. Comments on the neighborhood and the resident's enjoying the neighborhood. Concerned
with the one access/exit from Burney Lane into the neighborhood and the added capacity of
the development for safety concerns. Flooding concerns with property adjacent to lake.
Concerns with maintaining the tranquility of the neighborhood.
4. Opposed to development for environmentally sensitive area, does not fit the style of the
neighborhood, and place a street adjacent an existing property and faces the front of an
existing house.
5. Comment on the integrity of the neighborhood that is rural and spread out, equine flavor, and
enjoyed the wildlife without a fence on their property. Do not want to block the access for the
wildlife into the neighborhood. Concerned with the proximity of the Lot 2 to their property and
does not show any buffering be adjacent to their property or tree preservation.
6. Deed properties stated the properties cannot be subdivided and the lots adjacent to the
proposed development are much larger than the proposed development. Opposed to the
development.
7. Comment on that the City ordinances do not accommodate the wildlife and wildlife corridor and
flowage easement will cut out the wildlife access. Concerned with the drop off the slope at this
development and erosion. Wants the preservation of the ecosystem. Opposed to the
development and their HOA.
8. The development would impact he ecosystem and would increase in traffic. Would disturb the
ambiance of the neighborhood and we would want to protect it. Would not be in favor of the
development.
9. The proposal will not meet the current aesthetics of our existing neighborhood. We do not have
curbed and guttered roads with a sidewalk. We do not have a HOA and this development would
have any HOA. Putting a street through a lot to access land that is not part of our neighborhood
would not beneficially for our neighborhood or the wildlife.
10. Neighborhood would like to see this development developed like Harbor Oaks, an exemplary
development of early Southlake with equestrian, wildlife, flora and fauna, access to the Corp
property, lots over 2 acres in size and width, protected and new growth trees, and other
elements. Opposed to the smaller lots than in Harbor Oaks and easement used in lot size, lot
width, and not in character in the neighborhood. Development wrong for the area. Concerned
with emergency access, water and other utilities with the new development.
11. Comment on cutting into an existing lot with the curb and gutter street, clearing the land for the
development and the effect on the wildlife, increase in traffic, and the establishment of a HOA.
12. Disagrees with the location of the street that will shine lights on the front of her house as
discussed previously. Concerned with the tree preservation after the lots are developed
(enforcement of tree preservation after development complete for the homeowner adds
additional elements). Opposed for the effect on the environment, herself, and her neighbors
living near the development. Concerned with the 2035 Plan and the mission statement and
that is in opposition to this development. Preserve the environment and neighborhood.
13. Concerned with traffic, environment, emergency access, and the street running through an
existing lot.
14. Comment on the proposed development that is opposed to their existing neighborhood
lifestyle, wildlife, and is similar to the other neighborhoods in Southlake. Their neighborhood is
highly sought after by people.
15. Concerned with the access road, having enough acreage for the aerobic system, and filling
the land for building and its effect on the lake. Concerned with the lots that back up the existing
lots and the proposed lot sizes not being comparable in size. Wants City to honor the 2035
Plan as written. Drainage and environmental concerns in this area.
16. Opposed to the negative impact on the neighborhood and developers presenting one plan to
the neighborhood and another to the home buyers.
17.Opposed to the new development as the developer was not willing to make substantial
changes as the neighbors requested in the Zoom meetings (with the neighborhood).
18. Generally opposed to the development as the neighbors selected the neighborhood for its rural
character, quiet streets, and uniqueness. Opposed to the new road into the development.
Contrary to 2035 Plan. Concerned with drainage and aerobic systems and proximity to the
lake, tree preservation, and headlights into a neighbor's house.
19. The majority of the neighborhood is opposed to the development and the development is
detrimental to us. It is not the neighborhood's responsibility to fix the landlocked access.
Proposed lots are smaller than the neighborhood lots. Concerned about access point to the
Corps property and where the cars are going to park. Concerned about the wildlife.
Developer's responses to comments (bulleted for ease of reading):
• Believes that they have gone above and beyond in design standards for larger lots.
• Average lot size is 1.7 acres (SF-1A is 1 acre in the city - minimum). Proposing larger lots.
• Drainage concerns- lots drain onto their property (hired professional engineers for the
development).
• Comply with city standards for development on the property.
• The Corps 572-flowage easement is not the 100-year flood plain (development well above
the 100-year floodplain except for one small area with flood plain).
• Believe that their home values, lot sizes and standards are compatible with the neighborhood
as there have been several teardowns and rebuilds in the neighborhood the last 3-5 years
with larger homes.
• Met with the City Fire Marshal and he does not have concerns with the development for fire,
health and safety standards. Full 100-foot diameter cul-de-sac turn around meets standard
for school buses and fire trucks. Houses will be required to be fire sprinkled.
• Sidewalks are not going in the development as inventoried by the residents.
• Entry sign is needed to separate the development from Harbor Oaks and sign will have soft
lighting. If the neighborhood does not want lighting- would be fine with that.
• Property is disadvantaged- property owner has the right to develop the property. Wants to do
the best for the property owners of the two properties.
• Trying to develop the property that will work for everyone.
• Trying to work with the wildlife concerns and not restrict their access.
• Wants to work with the neighborhood and residents on a case by case basis.

Question or Comment Hello! My name is Lisa Boyer. I live in Harbor Oaks on Harbor
Refuge Street. I am extremely concerned about the proposed
zoning change and development at 2970 Burney Lane. I have
attended a couple of the zoom meeting hosted by Sage
Development. I have several concerns. I moved to this
neighborhood in 2013 because we loved the unique homes
with larger lots of 1.5 acres and above. I feel like we live in the
country even though we are down the street from Southlake
Town Square and Central Market. The proposed development
is not in line with our neighborhood. We do not have sidewalks
and HOAs. We have horses and goats and several bird species
that live in our unique neighborhood. I feel like 8 homes would
be a huge environmental impact on our neighborhood since it is

situated so close to Lake Grapevine. There is already an
amazing ecosystem there that would be disrupted if 8 homes
were built on those 13.2 acres. Would Sage Development
consider building 3-4 homes instead of the proposed 8 homes?
My other concern is that we have deed restrictions here in
Harbor Oaks that prevent you from breaking up an existing platt
unless there is a vote on the changes. I live across the street
from a 5 acre lot. My concern is that if we start breaking up
existing platts then we would start doing that to all the large
acre lots that already exist in our neighborhood. That would
greatly impact my home value in the future if I am surrounded
by 1 acre lots or lots that are less than one acre. I understand
that Sage Development is looking to bring value to Southlake
but in this instance I believe Southlake would lose value if we
allow 8 homes to be build on these 13.2 acres. What else can
we do to that land to preserve the Harbor Oaks Community?

Question or Comment I am strongly opposed to this development. I do not believe we
should place a new street adjacent to an existing lot that also
faces the front of an existing house. In addition, the proposed
development does not fit the style of our existing well -
established neighborhood. Also, the property is an
environmentally sensitive area and the city should work to
protect such areas immediately adjacent to Lake Grapevine.

Also the home lot sizes that are currently next to the proposed

Question or Comment The Sage Group is cutting a new road through an existing lot?
And putting in curbs and sidewalks which are not the look of
ourwell established neighborhood.
The land they will clear out disturbs the wildlife habitat for many
animals.
The 9 or 10 homes will increase the traffic at a minimum of 20
cars.
They plan to establish an HOA which is 180 degrees different
from the existing neighborhood.

Question or Comment We live on Burney Ln where a developer is proposing to put a
roadway through an existing lot. This is a deed restriction
violation because this lot is not supposed to be subdivided.
Also, the proposed roadway is not compatible with our current
road of 60'. The proposed road is only 24' at the entrance and
then 25'. The fire department has stated that this does not meet
requirements.
The ecological impact of the proposal is in direct conflict with
the 2035 Southlake Plan that promised preservation of our
fragile ecological areas in the north corridor.
We also have serious concerns about adding more homes on
an already overloaded road, with one way in and the same way
out. How does this work in the case of an emergency? Traffic?

Re: Proposed Development of the Miles Property adjacent to
the Corps Property off of Burney Lane
I have been asked by my neighbors to address some of the
environmental issues of which they have concern with the
proposed development off of Burney Lane. Because the issues
are many, I have narrowed it to just a few presented here.
When we address the proposed Sage development, we are not
talking about some two-dimensional entity that fits into a nice
set of pre -assigned development parameters. It is adjacent to
one of the last pieces of critical and significant indigenous

habitat left in Southlake that contains space, trophic levels to
support fauna diversity, and a natural ecosystem that can be
self-sustaining. It contains riparian, upslope, mudflats, stream
flowage, and wetland environments as well as a diversity of
vertical habitats. It literally and physically is a component of the
Bob Jones Nature Preserve separated by fewer than several
hundred yards of Lake Grapevine. (During dry seasons, the two
areas can be contiguous.) Any construction proposed adjacent
to it must take into consideration both the immediate and also
the long-term effects on this valuable commodity that belongs
to the citizens of Southlake.
The second component is the adjacent neighborhood that is
SF-1A zoned and is a neighborhood of long-standing
established homeowners who purchased property placing a
high value on the retention of the rustic, bucolic, native
ecosystem, and family -oriented environment that makes it so
special. The proposed plans call for the zoning designation to
be changed from Ag to R-PUD to incorporate the flexibility that
designation allows. If I understand correctly by not seeking the
SF-1A zoning, the structure coverage limit of 20 percent is
removed and the development has the freedom to differ
significantly from the surrounding Harbor Oaks subdivision. And
though 20 contiguous acres are not present and prevent a
Rural Conservation Development zoning being used, probably
no other piece of property in the city should be as visibly and
virtually considered for such zoning.
The City has incrementally given away much of its natural
heritage in granting developments that do little if anything to
actually conserve, much less preserve natural lands. For
example, if this property plan is approved there will be nothing
to consider future street or yard lighting that can have a limiting
effect on fauna migrating within the juxtapositioned wildlife
corridor or its dramatic effect on nesting bird populations.
Without fencing restrictions such as those in the Rural
Conservation Developments, a development like the one
proposed can literally shut down the wildlife corridor forever.
Maybe not important to consider in development but are
significant to the adjoining natural ecology of the area.
When lake levels rise on the east side of the Kirkwood -Quail
Creek drainage system the water moves up into the flowage
easement on the property being proposed for development.
This action, once the property is developed, will shut down the
total wildlife corridor for possibly months at a time. The sharp
contour of the slope funnels the wildlife corridor into a very
narrow strip on this side of the riparian stream system. As a
result, it is extremely sensitive to the extent of exposed land
that actually would be available as a corridor. The sealing off of
this corridor during these times will virtually destroy the integrity
of a corridor for indigenous wildlife populations and will initiate
habitat loss and fragmentation. Some of the very reasons that
Black -chinned Hummingbirds have suffered a 55 percent
decline; Painted Buntings, a 66 percent decline, and Harris
Sparrows, a 75 percent decline. Even with these significant
declines nationally because of habitat loss, they do not include

birds like the Chuck -Wills Widow which was so common in the
area being discussed reduced to just one and possible two
nesting pair this past nesting season. This is what is happening
when we do not consider the special needs of areas in the City
we are incrementally destroying.
What makes this ecological conservation area so powerful are
its layers of plant life; everything from natural grasses to the
Cross -Timbers forests. It is the in-between vertical plant life that
literally gives life to the system; the native herbs, new bush
growth, and the short tree understory that breathes life into the
system. Two-thirds of all birdlife live in that area and that is
where the overwhelming nesting and denning potential for birds
and native animals resides. If this development removes the
understory in the areas being described, sixty-six percent of the
wildlife dependent on the understory will be removed from the
zone. One only has to look at the Ridgecrest addition to see the
effects of land clearing. The City has earmarked this proposed
development area on its environmental maps as a sensitive
tree area to be protected. The proposed footprints of the
dwellings are listed at minimums and do not contain swimming
pools, tennis courts, servant's quarters, or possibly external
"sheds" each of which will require removing both trees and
understory. Even within the flowage easement, removal of
valuable habitat will be a given and there is no covenant of
protection anywhere in the planning.
There is mention of an easement as an "Open Space,
Pedestrian, Wildlife Easement" that the developer said will have
stipulations in the homeowner's association contract. We have
all experienced the homeowner's association changing the
rules and the City taking the position that is has no authority at
that point. That hardly is a "contract" to legally protect this
delicate environment belonging to the citizens of Southlake.
The proposed potential public access route takes the path
down the most sloping part of the adjacent Corps property. It is
an open invitation for rapid erosion of this sensitive soil. Already
trail erosion across City trails on leased Corps property are
dumping tens if not hundreds of dump truck loads of soil into
the catch basin of the lake. Why is this an important issue?
From previous ecological studies done by the Texas Parks and
Wildlife Department, we know the habitat value of this area is
0.7 meaning that at its very best it is only 0.7 of what an ideal
habitat would be. Or conversely, it would take 1.42 acres to
regain an ideal habitat if an acre of the present soil is lost. At
the common-sense level, when erosion occurs in this area, we
are losing habitat potential at a rate much higher than what is
visible. It simply cannot be replaced.
This same erosion potential will exist in the several existing
erosional cuts that already exist. Once the vegetation above is
removed, the potential for continuous erosion will be
exacerbated overtime. This kind of habitat loss from preserved
natural areas does not seem to be a consideration in the City's
erosion control ordinances.
I submit these small but significant discussion items related to
this proposed development simply because it is part of a

greater piece that unless addressed and considered will
continue to degrade and actually remove the last remaining
remnants of our natural history of which the City is the steward.
I have submitted three past documents to the Parks Board,
Planning and Zoning, the City Council, and the City Manager
that provide supporting evidence including photographs that
support the rationale to at least stop, look, and listen to the
voiced needs to consider our natural environment heritage
before just looking to fill this empty piece of land. There is also
a glaring argument to try to actually preserve what was once
Southlake's natural history for future generations. Sometimes
we just have to do the right thing.

Question or Comment I oppose this development mainly due to the negative impact it
will have on our existing neighborhood. Other developers have
tried similar plans, but as we have found, developers have an
agenda to present to the neighborhood, and another they
present to buyers. Once a buyer is interested, all promises are
off the table. If the existing neighborhood was able to hold
positions in the new HOA, it would give us a voice in future
plans. Without that, the developer and new owners will have
free reign to do as they please.

Question or Comment We are opposed to the proposed new development in the
Harbor Oaks subdivision, a neighborhood we have lived in for
more than 35 years. We not able to participate at the Spin
meeting, but want our position on the record. Over the past
month, we participated in several of the Zoom calls that our
neighborhood had with the developer, but he showed no
willingness to make any substantial changes. We do plan to
join with our neighbors on making our arguments against the
zoning change and development plan at both the upcoming
Planning & Zoning and City Council meetings.

Question or Comment We are generally opposed to this development for a number of
reasons. Residents of the neighborhood proactively chose this
neighborhood for its rural feel, quiet streets and uniqueness.
This development would dramatically change the
neighborhood. The proposed access through an existing lot
requires a plat change which requires 100% approval from
existing Harbor Oaks residents; a restriction designed to help
maintain the uniqueness of the neighborhood. City approval of
this development would violate this restriction and take the
decision out of the hands of the residents who proactively
chose this neighborhood. The proposed road to enter property
would result in headlights shining directly into one of the
existing homes in Harbor Oaks and would be built along the
property of another homeowner with a special needs child, both
of which we find unacceptable. This development is contrary to
the 2035 Southlake Plan which strives to "preserve rural

settings among established estates". Drainage is a significant
concern as the property will require the use of aerobic septic
systems next to the Flood Plain and will most likely exacerbate
existing drainage issues. Finally, I would encourage all
Board/committee/council members who are charged with voting
for/against this issue to visit the property. The property is
uneven, has numerous gullies and is teeming with wildlife and
significant vegetation given is proximity to the lake.
Development of this property will be difficult and require
removal of the vast majority of the trees and vegetation. While I
know virtually any property can be developed, I frankly don't
think this property should be as I don't think it lends itself to
being developed. Thank you.

Question or Comment We did not have a comment for the virtual spin meeting
however after watching the meeting, we do want to clarify some
markings on one of the developers plans.
They showed surrounding properties with dashed white lines
however they appear to have made a mistake on the property
delineation on our property.
We live at 880 Harbor Ct and our property backs up to lots 6
and 7 of the proposed development.
They have the white dashed property line representing our lot
running right through the ,middle of our house and not the true
property boundaries.
This needs to be corrected if the same slide is to be used in
future meetings.
Both lots 6 and 7 are directly behind our property.
The way the lines are now make it look as if only one house
