PERMANENT PEDESTRIAN ACCESS EASEMENT

COUNTY OF TARRANT §
That I, MPA Southlake MOB, LLC, GRANTOR herein, for and in
consideration of the sum of Ten ($10.00) Dollars and other good and valuable
consideration in hand paid by the CITY OF SOUTHLAKE, home rule
municipal corporation of the County of Tarrant, State of Texas, GRANTEE
herein, the receipt and sufficiency of which is hereby acknowledged and
confessed, do hereby grant, sell and convey unto the said GRANTEE a
permanent and perpetual easement for the purpose of installing, repairing,
maintaining, altering, replacing, relocating, rebuilding, removing, and
operating permanent public sidewalk facilities in, into, upon, over, across,
under and through all that land in Tarrant County Texas described as
follows, to -wit:
A 15 foot by 16.5 foot wide Permanent Pedestrian Access Easement

containing approximately 0.003 acres, as more particularly described
22 in Exhibit "A" and shown on Exhibit `B" attached hereto and

together with the right of ingress and egress as necessary for such purposes.
GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs,
representatives, successors and assigns shall at no time erect, place or
construct, or cause to be erected, placed or constructed in, into, upon, over,
across or under any easements granted herein any temporary or permanent
structures, and it is further agreed that GRANTEE shall have the right to
excavate and fill upon said permanent easement and to remove from said
permanent easement, any fences, buildings or other obstructions as may now
be found upon said permanent easement.
It is further intended that the Permanent Pedestrian Access Easement herein
granted to the GRANTEE shall run with the land and forever be a right in
and to the land belonging to GRANTOR, and GRANTOR'S successors and
assigns, and said grant is expressly excepted from any right of reversion of
said premises under any prior deeds in GRANTOR's chain of title. The
Permanent Pedestrian Access Easement, rights and privileges granted
therein are exclusive, and GRANTOR covenants that it will not convey any
other easement or conflicting rights within the area covered by the grant to
any other person.

CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS
BEING a tract of land situated in the Thomas Easter Survey, Abstract No. 474, the City of Southlake, Tarrant
County, Texas, and being a portion of Lot 1, Block 1, Nolen Office Park Addition, an addition to the City of
Southlake, Tarrrant County, Texas, as shown on plat thereof and recorded in County Clerk's File No. (CC#)
D213017713, Official Public Records, Tarrant County, Texas (OPRTCT), and being more particularly
described by metes and bounds as follows: (Basis of bearing being U.S. State Plane Grid - Texas North
Central Zone (4202) NAD83 as established using the AIITerra RTKNet Cooperative Network. Reference
frame is NAD83(2011) Epoch 2010.0000. Distances shown are U.S. Survey feet displayed in surface values.)
BEGINNING at a 5/8 -inch iron rod found for the northeast corner of the said Lot 1, being common with the
southeast corner of a called 4.098 acre tract described by deed to South Nolan Medical Investment, LTD
and recorded in (CC#) D218119208 and being in the west right of way line of South Nolen Drive ( a 70 Foot
right of way), also the PC of a curve to the left, having a radius of 435.00 feet;
THENCE with said east line of said Lot 1 and being common with the west right of way line of the said South
Nolen Drive, also, with said curve to the left, having a central angle of 02°10'24", a chord bearing and
distance of South 21044'58" East, a distance of 16.50 feet, an arc distance of 16.50 feet to a point for
corner, from which a 5/8 -inch iron rod found for the southeast corner of the said Lot 1 bears, continuing
with said curve to the left, having a radius of 435.00 feet, having a central angle of 15°04'21", a chord
