PUBLIC HEARING Action Requested: Ordinance No. 1237, 2nd reading, abandoning a portion of a drainage easement on Lot 4, Block 1, Kirkwood Hollow Phase II, an addition to the City of Southlake, Tarrant County, Texas, being located at 512 Round Hollow Lane. PUBLIC HEARING Background Information: The Homeowners of Lot 4, Block 1 of the Kirkwood Hollow Phase II subdivision are requesting that the City abandon a portion of the existing drainage easement recorded in Cabinet A, Slide 6044. The easement is located in the rear yard of the property, 512 Round Hollow Lane, along the South Fork of the Kirkwood Branch. The easement encompasses 0.25 acres of the 0.71-acre property. The document was recorded on August 9, 2000 under Cabinet A, Slide 6044 granting the City of Southlake a drainage easement in the rear yard of the lots adjacent to the South Fork of the Kirkwood Branch. The Homeowners requested Cumulus Design, LLC, a Civil Engineering firm, to provide a drainage study to determine whether the existing drainage easement was larger than necessary. Upon further evaluation it was determined that the boundaries of the drainage easement were greater than required. The associated FEMA Flood Insurance Study and FIRM Map, as well as the onsite topography where used to determine the 100-year base flood elevation for the property. The 100-year base flood elevation plus one-foot of freeboard, to comply with Article V – Flood Hazard Reduction regulations, was used to determine the area of the drainage easement abandonment. The existing drainage easement is wider than the existing flood plain and, based on the results of the drainage study, will remain wider than the flood plain once the subject portion of the easement is abandoned. The drainage study from Cumulus Design, LLC has been included for reference. Item 6A Page 2 of 2 Financial Considerations: The applicant has provided the City with the filing fee costs. MARTIN SURVEY ABSTRACT NO. 1134 OF THE TARRANT COUNTY RECORDS, LOCATED IN THE CITY OF SOUTHLAKE; DECLARING THAT A PORTION OF SUCH EASEMENT IS UNNECESSARY FOR USE BY THE PUBLIC; AUTHORIZING THE MAYOR TO EXECUTE QUITCLAIM DEEDS RELEASING PUBLIC INTEREST OF THESE EASEMENTS; PROVIDING A SEVERABILTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas (“the City”) is a home rule city acting under its power adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council of the City of Southlake, after careful study and consideration, has determined that the portion of the easement, located in the City of Southlake, recorded in Cabinet A, Slide 6044 is not being used by, nor useful or convenient to the public in general; therefore, it would be better served and benefited by its vacation and abandonment; and WHEREAS, in order to remove any question as to the continued interest in the easements, the City desires to execute a quitclaim deed releasing all title and control in said easement to the owners of the property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1 A 0.19 acre portion of the drainage easement located on Lot 4, Block 1 of the J.B. Martin Survey in the City of Southlake, more specifically described in the county records in Cabinet A, Slide 6044. The easement records attached hereto and incorporated herein for all purposes, are not being used by, nor useful or convenient to the public in general and the public would be better served and benefited by their vacation and abandoned as public easements. SECTION 2 The Mayor of the City of Southlake, Texas, is hereby authorized and empowered to execute quitclaim deed for the above mentioned property in Section 1 to the following entity: Thomas and Bryanna Roop. Ordinance No. 1237 2 SECTION 3 Copies of said quitclaim deeds shall be presented for filing with the County Clerk of Tarrant County, Texas by the office of the City Secretary. SECTION 4 It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5 This Ordinance shall be in full force and effect from and its passage, and it so ordained. Thesiteslopestothewest,aroundtheexistinghouseintothecreek.Thecreektothewestofthehouse isknownastheSouthForkoftheKirkwoodBranch.TheSouthForkoftheKirkwoodBranchhasbeen studiedbyFEMAandtheresultsoftheirstudyareshowninthefloodinsuranceratemap48439C0085K, datedSeptember25,2009.Thereisalsotheavailablefloodinsurancestudy(FIS)aswell,number 48439CV006A,datedSeptember25,2009.Thepropertyhasasmallamountoffloodwayinit,witha sectionof100yearfloodplainandasectionof500yearfloodplain.Aphysicalinspectionofthefloodway andfloodplainswerenotperformedaspartofthisanalysis.TheFEMAfloodmapandtherelevantFIS sheetsareincludedintheappendixasExhibit3. 3 ANALYSISCRITERIA Thedrainagesystemwasanalyzedusingboththeexistingphysicalsysteminformation,FEMAfloodmap, andtheFISelevationsretrievedfromthegraph.Thephysicalsitetopographywasobtainedbyan independentsurveyorthatpreformedatopographicsurveyofthesiteandtiedthesurveyintoNorth AmericanVerticalDatum.Partofthesurveyalsoincludedtheexistingfloodway,100and500year floodplainboundariesasshownontheFEMAfloodmap.TheFISinformationwasobtainedfromthe FEMAwebsiteandwasusedtodeterminetheapproximate100yearwatersurfaceelevationsatthe northwestandsouthwestpropertycorners. Basedontheexistingplat,itappearsthethatthe100yearfloodwaywasaddedtotheplatto approximatethelocationofthefloodway,takingthegeneralshapeandsizebasedontheFEMAflood mapatthetime.Theexistingdrainageeasementwastakenfromthefloodwayandappearstohave beenoffsetfromthefloodwayline.However,lookingatsomeareasoftheplat,itappearsthedrainage easementwaskeptinsimple,straightlinesegmentswithoutanyregardstositetopographyand variationsinthefloodplain.Thiscanbeseenonbothlot4(subjectproperty)andtheadjacentlot5.As canbeseenonthesurvey(exhibit2),whilethefloodwayvariesinlocationacrossthesite,thedrainage easementisastraightlinewithoutregardstothetopography.Thisisacommonpracticetominimize andsimplifytheamountoflineworkonplat. BasedontheFloodInsuranceStudyfortheSouthForkoftheKirkwoodBranch(includedasexhibit3), the100yearwatersurfaceelevationatthenorthandsouthendare575.9and576.1,respectively.The aforementionedstudycontainsaprofileofthestreamwithvariouslabelsofcrossingstreets. Measurementsweretakenonthefloodmapbetweenthesestreetstothepropertylines.Usingthese measurementsandthestreamprofile,the100yearwatersurfaceelevationswerecalculated.Several measurementsweretakenandused,withthemostconservativevalueusedtoaddafactorofsafety intotheestimate.Thesewatersurfaceelevationswereshownandlabeledonthedrainageexhibit. DRAINAGEANALYSISANDRESULTS Withthedatagatheredfromthevarioussources,theexisting100yearwatersurfaceelevationwas drawnontothetopographicsurveyofthesite.Thelimitsofthe100yearwatersurfaceelevationwas tracedfollowingtheexistinggroundsurfaceandcalculatedwatersurfaceelevationpoints.Thislinehas beenshownonthedrainageexhibit(exhibit4).Thisexhibitalsoincludestheexistingcontours,physical features,andexistingimprovements. PertheCityofSouthlakeCodesofOrdinances,Chapter9.5,section9.5Ͳ65,itstates;“openchannel easements:Channelimprovementsshallbelocatedineasementsofsufficientwidthtocontainthe ultimate100Ͳyearstormplusonefootoffreeboard.”Inordertoprovidethiseasement,theexisting100 yearwatersurfaceelevationthatwasdrawnearlierwasusedasabasistodeterminevariouselevations acrosstheproperty.Fromtheseelevations,asecondlinewasdrawntorepresenttheonefootof freeboard,whichalsorepresentstheedgeoftheeasement.Thislinehasbeenincludedandlabeledon exhibit4. 4 Uponcompletionofthedrainageanalysis,theresultswereshowninexhibit4andhavebeenincluded aspartofthisstudy.Fromthedataanddrawing,theredoesappeartobeareaoftheexistingdrainage easementthatdoesnotneedtobeinadrainageeasement.
