The existing property is located within the floodzone AE which has a base flood elevation
of 575’. The flood ordinance requires that any new structure or substantial improvements
shall be required to comply with the regulations within the flood ordinance. No
modifications to the property are required for zoning changes, however, to complete a
plat for the property a drainage easement for the existing creek shall be required, meeting
the requirements outlined in the drainage ordinance. The drainage ordinance requires
that an easement with sufficient width to contain the 100-year storm plus one foot of
freeboard be dedicated to the city. Since the majority of the property is located within the
100-year storm flood plain boundary, the existing residence will most likely encroach into
the required drainage easement. The City is open to reviewing an encroachment
agreement to allow the current residence to encroach into the drainage easement,
however, sufficient information shall be provided with the encroachment agreement
showing that there would be no adverse effects due to the encroachment. The
encroachment agreement would be required to run with the plat and be recorded
together. A note would also be required to be placed on the plat stating that new
construction and/or substantial improvements done on the property shall conform to the
City of Southlake Flood Ordinance requirements.
