2020-08-13 ZBA Minutes ► CITY OF SOUTH LAIC TEXAS ZONING BOARD OF ADJUSTMENT MEETING: August 13, 2020 LOCATION: 1400 Main Street, Southlake, Texas' Regular Session-City Council Chambers Members Present: Board members: Vice Chair David Treichler, Austin Reynolds Place 4, Hannah Smith-Alternate 1, Robert Kemins-Alternate 2, and Clinton Snead-Alternate 3 Members Absent: Chair Jeff Medici, Michael Quinones- Place 1, Trey Verbick, Place 3, and Heather King-Alternate 4. Staff Present: Dennis Killough, Deputy Director of Planning & Development Services, Richard Schell, Principal Planner, Miranda Picklesimer, Board Secretary and Katie Blizzard. REGULAR SESSION: 1. Call to Order: Acting Chair Treichler called the Regular Session to order at 6:30 P.M. 2. Executive Session: No executive session was held. • 3. Approval of the Minutes: Acting Chair Treichler opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on June 11, 2020. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on June 11, 2020. Motion: Kemins Second: Reynolds Ayes: Treichler, Reynolds, Smith, Kemins, and Snead Nays: None Abstain: None Vote: 5-0-0 Motion: Approved 4. Administrative Comments: Richard Schell, ;Principal Planner, announced that the City Council appointed members to the Boards and Commissions at their June 16th meeting. Planner Schell then welcomed the new members and introduced staff member Katie Blizzard, a future Board Secretary. Planner Schell also announced that the next meeting is scheduled for August 27, 2020 and that there are no submittals for that meeting. Agenda Item No. 5 ZBA20-0007- Special Exception Use per Ord. No. 480, as amended, Section 44.12(2) for accessory buildings or structures of a size or aggregate size greater than that permitted on property described as Lot 1, H.O. Throop No. 1273 Addition, an addition to the City of Southlake, Denton County, Texas, and located at 808 E. Bob Jones Rd., Southlake, Denton County, Texas. Current Zoning: "SF-30" Single Family Residential District. Zoning Board of Adjustment Meeting Minutes—August 13, 2020 Page 1of3 Planner Schell presented details of the case with a slide show presentation to the Board. The applicants, Brian and Melissa Rukema, are requesting approval of a Special Exception Use for accessory buildings or structures of a size or aggregate size greater than that permitted to allow an approximately 1,008 square foot accessory building in addition to an existing approximately 396 square foot accessory building and an approximately 32 square foot chicken coop for a total of approximately 1,436 square feet of accessory buildings and structures on the property. The maximum area permitted for the sum total of accessory buildings and structures in the "SF-30" Single Family Residential zoning district regulations is 750 square feet. The area of the lot is approximately 41,385 square feet or 0.95 acres. Acting Chair Treichler opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Melissa Rukema, 808 E. Bob Jones, Southlake, Texas, the applicant and owner, once sworn in, presented testimony, and answered questions from the Board. Acting Chair Treichler asked if there were those in the audience who wished to speak in support of the request. Pedram Farahnak, 816 E. Bob Jones, Southlake, Texas, once sworn in, presented testimony, answered questions from the Board and spoke in opposition to the request. Acting Chair Treichler asked if there was anyone else who wished to speak in opposition to the request. There being none, Acting Chair Treichler called upon the applicant or the applicant's representative for a brief rebuttal. Melissa Rukema, 808 E. Bob Jones, Southlake, Texas, the applicant and owner, presented testimony and answered questions from the Board. Acting Chair Treichler closed the public hearing and opened the item for discussion from the Board. A motion was made to approve case ZBA20-0007 as presented. Motion: Kemins Second: Reynolds Ayes: Treichler, Reynolds, Smith, Kemins, and Snead Nays: None Abstain: None Vote: 5-0-0 Motion: Approved Agenda Item No. 6 ZBA20-0008-Variance to Zoning Ordinance No. 480, as amended, Section 11.5.c requiring a side yard of not less than 20' on property described as Lot 1, Block 2, Continental Park Estates, an addition to the City of Southlake, Tarrant County, Texas, and located at 1213 Timber Ct., Southlake, Tarrant County, Texas. Current Zoning: "SF-1A" Single Zoning Board of Adjustment Meeting Minutes—August 13, 2020 Page 2 of 3 Family Residential District Planner Schell presented details of the case with a slide show presentation to the Board. The applicant, James Borden, is requesting approval of a Variance to Zoning Ordinance No. 480, as amended, Section 11.5.c requiring a side yard of not less than 20' to allow an approximately 1,173 square foot one-story addition to the principal residence to be constructed approximately 12' from the side lot line. The front porch that is shown on the elevations encroaches into the front yard setback and it will require approval of a separate variance. Acting Chair Treichler opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. James and Adrienne Borden, 1213 Timber Ct, Southlake, Texas, the applicant and owners, once sworn in, presented testimony, and answered questions from the Board. Acting Chair Treichler asked if there were those in the audience who wished to speak in favor of the request. There being none, Acting Chair Treichler asked if there were those in the audience who wished to speak against the request. There being none, Acting Chair Treichler closed the public hearing and opened the item for discussion from the Board. A motion was made to approve case ZBA20-0008 as submitted.
