REGULAR SESSION: 1. CALL TO ORDER Chairman Kubiak called the meeting to order at 6:30 P.M. 2. Executive Session: Pursuant to the Open Meetings Act, Chapter 551, Texas Government Code, Sections 551.071. Refer to posted list attached hereto and incorporate herein. Executive Session may be held, under these exceptions, at the end of the Regular Session or at any time during the meeting that a need arises for the Planning and Zoning Commission to seek advice from the City Attorney as to the posted subject matter of this Planning and Zoning Commission meeting. Section 551.071: Consultation with attorney. No Executive Session was held. No action was taken at this time. 3. CONSIDER: APPROVAL OF THE AUGUST 20, 2020 PLANNING AND ZONING MEETING. Commissioner Rothmeier made a motion to approve the August 20, 2020 Planning and Zoning meeting minutes. Chairman Kubiak opened the public hearing. No one came forward to speak. Chairman Kubiak closed the public hearing. A motion was made to approve item 8, ZA20-0043 subject to the staff report dated August 28, 2020 and Plat Review Summary No. 1 dated August 27, 2020 and subject to meeting the residential standards as defined by the Fire Department and other surface requirements as defined. A motion was made to approve item 7, ZA20-0038 subject to the staff report dated August 28, 2020 and Site Plan Review Summary No. 2, dated August 28, 2020 and granting the variance requested for the interior landscape requirement. CURRENT ZONING: “AG” AGRICULTURAL DISTRICT. REQUESTED ZONING: “S-P-2” GENERALIZED SITE PLAN DISTRICT. SPIN NEIGHBORHOOD #8. PUBLIC HEARING Deputy Director of Planning and Development Services, Dennis Killough presented item 6 and opened for questions. Applicant – Clay Cristy with Claymoore Engineering Inc, 1903 Central Drive, Bedford, Texas, came forward to speak and answer questions. Chairman opened the public hearing. Victor Avila came forward to speak and address his concerns. Bobby Struempler came forward to speak and address his concerns. Varia Mihir came forward to speak and address his concerns. Deputy City Engineer, Steve Anderson came forward to speak and address the concerns of drainage. A motion made to approve item 6, ZA20-0040 subject to the following: • Deny the request to the sidewalk variance (S. Nolen Dr.) and requesting the applicant to present options to City Council that would address safety concerns; • Talking about enhancements to the landscape plan that were specifically addressing the bufferyard or areas adjacent to residential; • Recommendation to • For Phase 2, include the 13 permitted uses from Phase 1 and exclude the following specific uses listed for Phase 2: o 2. Apparel and millinery manufacturing and assembly. o 3. Book and stationery stores. o 5. Dry goods and apparel storage and distribution. o 13. Security guard quarters. o 15. Studios for training in fine arts. o 16. Builder's supply, stores or outlets providing that all materials are contained within a building. o 17.
