Item 9C - First National BankCase No. SV20-0014 S T A F F R E P O R T October 13, 2020 CASE NO: SV20-0014 PROJECT: Sign Variance for First National Bank EXECUTIVE SUMMARY: On behalf of First National Bank, SLI Group is requesting approval of sign variances to Sign Ordinance No. 704, as amended, for their new building located at 605 W. SH 114, Southlake, Texas. DETAILS: The property is generally located west of W. SH 114 and south of W. Dove Road; and bounded by Shady Oaks Drive on the west property line. The applicant is requesting a variance to Sign Ordinance No. 704, as amended, to allow one upper story attached building sign for the First National Bank sign on the east elevation, an upper story illuminated clock, approved with the zoning change and site plan,on the east elevation (shown on the approved site plan elevation), and the clock blade sign from the Southlake Town Square location. Additionally, there are two (2) directional signs (reduced from 3 signs from the Sign Board motion), five (5) drive through signs, and a monument sign at the north driveway. The upper story illuminated clock was approved as part of the “S-P-1” zoning and site plan and is shown on the proposed sign plans. After the October 8, 2020 Sign Board meeting, the applicant has submitted revisions for the attached building directional signs, two site directional signs, options for the monument sign, and an additional attached building sign for the relocated clock from the Southlake Town Square building. SH 114 HISTORY: This is a building currently under construction – no sign history The following describes development history at this location: June 4, 2019; City Council approved a zoning change and site plan for the First National Bank on the property. (ZA19-0011) June 4, 2019: City Council approved a preliminary plat for Lots 1 and 2, Block 1, La Paloma Addition. (ZA19-0015) August 22, 2019; Planning and Zoning Commission approved a final plat for Lot 1, Block 1, La Paloma Addition. (ZA19-0045) August 23, 2019; the final plat was filed with Tarrant County under Instrument No. D219189743. SIGN BOARD: October 8, 2020; Approved (7-0) subject to the Staff Report dated October 2, 2020; and specifically noting, with respect to the variances, that the upper story variance is approved as requested, the upper story clock variance is approved as requested; however, also noting the specifics on the existing clock signage must be identified in terms of the location; with regards to the directional signs, approving signs #1 and #3 and denying sign #2, denying the request for the 3½ foot height and requiring the 3-foot height, denying the request for the 6 sq. ft. per sign face and requiring the 4 sq. ft. per sign face, and noting the applicant’s willingness and requesting the applicant to bring forward a masonry alternative and a plate sign alternative like to the Westin Hotel; and approving the drive thru signs, but limiting the letter height to 6-inches maximum and denying the 8-inch letters; and with respect to the monument sign, noting the commission’s (Sign Board) skepticism for the requirement of a monument sign, but also noting the applicant’s willingness to address options with the City Council with regard to the number of panels (either 4 or 6) and the requirements for the inserts while waiting on tenants on the south tract. STAFF COMMENTS: City Council approval of the proposed signs does not eliminate the requirement for appropriate sign application submittal prior to the installation of the sign. Variance Criteria: 9.6.2 VARIANCES Case No. Attachment A SV20-0014 Page 2 a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
