PROJECT: Sign Variance for One Stop Nutrition
REQUEST: Brandon Brown of One Stop Nutrition is requesting approval of variances to the
Gateway Plaza Phase II sign regulations and Sign Ordinance No. 704, as
amended, for an existing attached sign. The property is located at 2704 E.
Southlake Blvd., Suite 101, Southlake, Texas. The One Stop Nutrition lease
space is located within the Ga teway Plaza Phase II (Wyndham Plaza) and
generally located at the northeast intersection of N. Nolen Drive and E.
Southlake Blvd.
One Stop Nutrition is requesting a variance to the Gateway Phase II sign
regulations and Sign Ordinance No. 704, as amended, to allow a greater than
allowable sign width for the lease space, a greater than permitted overall sign
area, a pill box tag line sign and a backer plate for the channel letters as part of
the overall signage for the store. The pill box sign is part of their corporate
signage. The existing One Stop Nutrition sign on the building was relocated
from another local store and was placed on the lease space without an
approved sign permit.
The Gateway Plaza Phase II master sign plan for small retail spaces under
15,000 square feet allows for sign letters up to 30-inches in height and sign
area of .75 times the width of the building or lease space, but not limited to less
than 45 square feet. The lease space is approximately 18 feet 4 inches. The
existing sign width is 15-feet and exceeds the allowable width of 13.75 -feet.
The applicant’s proposal includes 17.5-inch letters with a black backer plate for
“One Nutrition” and a 27-inch octagonal “Stop” logo. The height of the pill box is
9.5-inch with 5-inch letters is proposed with a list of the business products. The
total sign area including the pill box is 50 square feet. The sign exceeds the
allowable width and sign area in the Gateway Plaza Phase II master sign plan
regulations. The sign will be face lit. Pill box signs are not permitted and
require a variance.

SIGN BOARD: August 6, 2020; Approved (6-0) subject to the Staff Report dated July
31, 2020; specifically approving the variances, but also noting the
motion is subject to the limitation of the pill box being removed 45 days
after City Council removes the temporary sign rights currently in place.
STAFF COMMENTS: At the May 9, 2019 Sign Board meeting , the Sign Board denied a sign
variance application (SV19-0003) from a different One Stop Nutrition
applicant for the One Stop Nutrition lease space. The previously
proposed sign did not include a backer plate. That application was
withdrawn prior to the City Council meeting.

City Council approval of the request does not eliminate the requirement
for an appropriate sign application submittal prior to sign installation.

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize variances to
any restriction set forth in this ordinance, including but not limited
to the number, type, area, height, or setback of signs, or any other
aspect involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall
consider the following criteria:
(i) Special conditions exist which are peculiar to the land,
structure or building involved and are not applicable to other
lands, buildings or structures in the same zone. The City may
attach such conditions to granting all or a portion of any
variance necessary to achieve the purpose of this ordinance,
and;
(ii) The strict interpretation of the provisions of the ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in the same zone under the terms of the
ordinance, and;
(iii) The special conditions and circumstances do not result from
the actions of the applicant and such conditions and
circumstances do not merely constitute pecuniary hardship
or inconveniences, and;
(iv) Granting the variance will meet the objectives of the
ordinance and not be injurious to the adjoining property
owners or otherwise detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to
alleviate the special hardship or practical difficulties faced by
the applicant in meeting the requirements of this ordinance;
and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s).
Any modification of the signage a pproved by the variance or
the installation of new or replacement signage that does not
meet the specific requirements of the City Council variance
approval is prohibited and will be deemed non -compliant.
Application Process. Any request for a variance s hall be made to the
Administrative Official and be accompanied by a completed application
and a non-refundable filing fee in the amount specified in the current fee
schedule adopted by City Council. The sign variance will be considered
by the City Council following a recommendation by the Sign Board. The
Sign Board’s recommendation will be forwarded to the City Council for
