A RESOLUTION REPEALING RESOLUTION NO. 20-006 PASSED ON
FEBRUARY 11, 2020 CALLING FOR A BOND ELECTION TO BE HELD IN
THE CITY OF SOUTHLAKE, TEXAS ON MAY 2, 2020
WHEREAS, the City of Southlake is a home rule City acting under its charter adopted by
the electorate pursuant to Article XI, Section 5, of the Texas Constitution
and Chapter 9 of the Local Government Code; and
WHEREAS, pursuant to a resolution passed by the City Council (the "Council') of the
City of Southlake, Texas (the "City") on February 11, 2020, a bond election
was ordered to be held in the City on May 2, 2020 (the "Election"); and
WHEREAS, in response to public health and safety concerns related to the novel
coronavirus ("COVID-19") infectious disease outbreak, the Governor of the
State of Texas (the "Governor") issued a proclamation on March 18, 2020
(the "Proclamation") authorizing political subdivisions, such as the City, that
would otherwise hold elections on May 2, 2020, to move their general and
special elections for 2020 to the next uniform election date, occurring on
November 3, 2020; and
WHEREAS, pursuant to a resolution passed by the Council on March 23, 2020, the
Election was postponed to November 3, 2020 or a date that may be
specified as an alternative in a future order issued by the Governor; and
WHEREAS, the Council further finds and determines that the measure referred to as
Proposition A in the February 11, 2020 resolution calling the election is moot
and should be removed from the ballot of the November 3, 2020 election;
and
WHEREAS, the Council hereby finds and determines that issuing bonds at this time
would not be in the best interests of the health, safety and welfare of the
City and its residents; and
WHEREAS, COVID-19 has created instability in the financial markets and in the national,
state and local economies; and
WHEREAS, the Council hereby finds and determines that the Election should be
cancelled because the impacts of COVID-19 on the City and its residents
renders the City unable to continue with the sale of bonds were the
proposition to pass and, therefore, renders the bond election moot.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS THAT:
SECTION 1. The Election is hereby cancelled, and all proceedings and actions to date
with respect to such election shall be of no force or effect.
SECTION 2. The City Manager or City Secretary are hereby authorized to forward a copy
of this Resolution to the Denton County Elections Administrator and the
Tarrant County Elections Administrator and the Proposition A referred to in
the February 11, 2020 resolution should be removed from the ballot of the
November 3, 2020 Election to be conducted by the Denton County Elections
Administrator and the Tarrant County Elections Administrator.
SECTION 3. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Resolution for all purposes
and are adopted as a part of the judgment and findings of the Council.
SECTION 4. All resolutions, or parts thereof, which are in conflict or inconsistent with any
provision of this Resolution are hereby repealed to the extent of such
conflict, and the provisions of this Resolution shall be and remain controlling
as to the matters ordained herein.
SECTION 5. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
SECTION 6. It is officially found, determined, and declared that the meeting at which this
Resolution is adopted was open to the public and public notice of the time,
place, and subject matter of the public business to be considered at such
meeting, including this Resolution, was given, all as required by Chapter
551, as amended, Texas Government Code.
SECTION 7. If any provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Resolution
and the application of such provision to other persons and circumstances
shall nevertheless be valid, and this Council hereby declares that this
Resolution would have been enacted without such invalid provision.
SECTION 8. This Resolution shall be effective immediately upon adoption.
