for and in consideration of the sum of Ten ( 10) Doll rs and
other good and valuable consideration in hand paid by Grantee
herein, the receipt and sufficiency of which is hereby
acknowledged and confessed, have granted, sold and conveyed, and
by these presents do grant, sell and convey to the CITY OF
SOUTHLAKE, Grantee herein, of Tarrant County, Texas a permanent
and perpetual easement for the purpose of installing, repairing,
maintaining, altering, replacing, relocating, and operating
utilities in, into, upon, over, across and under that land in
Tarrant County, Texas described as follows, to-wit:
Permanent utility Easement:
See attached Exhibit 'A' for metes and bounds description
See attached Exhibit 'c' for Graphic depiction
together with the right of ingress and egress as necessary for
such purposes, and an additional contiguous temporary
construction easement for a period of one (1) year for the
purpose of installing utilities on the property known and
described as follows, to-wit:
Temporary Construction Easement:
Immediately adjacent to the above described easement in a
configuration as described in the attached Exhibit 'B' and
shown on the attached Exhibit 'Ct.
Such temporary easements and permanent easements shall include
the right to excavate upon such property, but Grantee shall
replace any fences, improvements, or other fixtures upon said
property without cost to Grantor, or current owner thereof, and
shall restore the property, the subject of the temporary
easement, as nearly as possible to its condition prior to entry
thereon.
TO HAVE AND TO HOLD the above described easement, together
with all and singular, the rights and appurtenances thereto,
anywise belonging unto the said Grantee, its successors and
assigns forever; and I/We do hereby certify that I/We are the
owners of the property described herein and bind
myself/ourselves, my/our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said
Grantee, its successors and assigns, against every person
whomsoever lawfully claiming or to claim same or any thereof.

ACRE TRACT OF LAND CONVEYED TO NU WAY TRANSPORTS, INC., AS RECORDED IN
VOLUME 5341, PAGE 413, OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS
(DRTCn, SITUATED IN THE ABSALOM H. CHIVERS SURVEY, ABSTRACT NO. 299,
TARRANT COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
BEGINNING at the northwest corner of said 0.538 acre parcel, same being the northeast
corner of a called 1.436 acre parcel deeded to Jane Smith as recorded in Volume 8707,
Page 1407, DRTCT, and being at the beginning of a curve to the right in the south line
of Highway 114 (variable width) having a radius of 7529.32 feet;
THENCE with the north line of said 0,538 acre parcel and the south line of Highway 114
an arc distance of 45.19 feet, through a central angle of 00" 20' 38" and having a chord
which bears S 52" 34' 47" E, a distance of 45.19 feet;
THENCE S 34° 24' 31" W, leaving said line, a distance of 10.02 feet to a point on a
circular curve to the left having a radius of 7519.32 feet;
THENCE with said curve an arc distance of 38,48 feet, through a central angle of 00° 17'
