KNOW ALL MEN BY THESE PRESENTS:

tor and in consideration of the sum of Ten ($10.00) Dollars and
other qood and valuable consideration in hand paid by Grantee
hereln, the receipt and sufficiency of which is hereby acknowledged
and confessed, have granted, sold and conveyed, and by these
presents do grant, sell and convey to the CITY OF SOUTHLAKE, TEXAS,
( "cr-dntee") a permanent and perpetual easement for the purposes of
installing, repairing, maintaining, altering, replacing,
relocatinq, and operating utilities, (the "utility Easement") in,
into, upon, over, across and under that land in Tarrant County,
Texas described as follows, to-wit:
Permanent 20 foot Wide utility Easement:
See attached ExbJLbit "~, attached hereto and made a part
hereof, for a metes and bounds description
See attached Exhibit "B", attached hereto and made a part
hereof, for a graphic depiction
together with the right of ingress and egress as necessary for such
purposes, and an additional, contiguous, temporary construction
easement for a period of one (1) year. The right to use the
temporary construction easement shall commence upon commencement of
construction in the utility Easement and shall be upon, over, and
across that land in Tarrant County, Texas described as follows, to-
wit:
Temporary 40 foot wide Construction Easement:
Immediately adjacent to the utility Easement in a
configuration as shown on Exhibit "B".
Such temporary and permanent easements shall include the right to
excavate upon such property, but Grantee shall replace any fences
or other fixtures upon said property without cost to Grantor, and
shall restore the grade of that portion of the property which is
the subiect of the temporary easement, as nearly as possible to its
qrade prior to entry thereon.
TO HAVE AND TO HOLD the above described permanent easement,
together with all and singular, the .rights and. appurtenances
thereto, anywise belonging, unto the sald Grantee, lts successo~s
and assigns forever and the temporary easement unto the sald
Grantee, its successors and assigns for the period stated above;

to warrant and to forever defend all and singular the premises unto
the said Grantee, its successors and assigns, against every person
whomsoever lawfully claiming or to claim same or any thereof.

FIELD NOTES
Being a description of a 20 foot wide sani tary sewer easement
across that certain 13.72 acre tract located in the C, M, THROOP
SURVEY. Abstract 1510. Southlake. Tarrant County, Texas, conveyed
to Edqar A. Noack, et ux Romona, by deed recorded in Volume 4113,
Page 373, Deed Records, Tarrant County, Texas (D.R., T.Go., Tx.),
and being more particularly described by metes and bounds as
follows:
BEGINNING at a point in the common South line of said 13.72 acre
tract and approximate center of Dove Street, said point bears
Southeasterly 59-83/100 feet along said common line from the
Southwest corner of said 13.72 acre tract;
THENCE departing said Dove Street and common line, North 00 degrees
23 minutes 14 seconds East 29-48/100 feet to a point;
THENCE North 03 degrees 17 minutes 04 seconds East 395-26/100 feet
to a point; and
THENCE North 05 degrees 20 minutes 37 seconds West 41-68/100 feet
to a point in a common West line of said 13,72 acre tract and East
line of that certain 37.310 acre tract conveyed to Alvin F, Oien,
Jr" et ux by deed recorded in Volume 5414, Page 933, D,R" T,Co"
Tx. ;
THENCE with said common line, North 09 degrees 32 minutes 04
seconds East 77-89/100 feet to a point for corner, said point bears
along said common line South 09 degrees 32 minutes 04 seconds West
78-04/100 feet from a 5/8 inch iron pin found at an angle point in
said common line;
THENCE departing said common line and recrossing aforesaid Noack,
et ux 13.72 acre tract, the following:
South 05 degrees 20 minutes 37 seconds East 118-47/100 feet to
a point;
South 03 degrees 17 minutes 04 seconds West 396-26/100 feet to
a point; and

a point in the aforementioned common South line of said 13.72

place of beginning and containing some 0.234 acre or 10,181 square
feet.
