Good afternoon Mayor Hill,
I wanted to voice my opposition to the requested variance to the Noise Nuisance Code by Timmaron Golf Course (SPIN -
2020 -09). 1 understand this will come before the City Council on May 19th.
My concerns are as follows:
1. If a variance is approved, what makes the golf course operations a unique business that no other variances would
be approved for other landscaping companies or roofing companies, especially when one of Timarron's major
concerns was that of the workers and golf customers being able to complete work/start play before the heat of the
summer days. This is surely an argument that could be made by many companies operating in the Texas heat.
2. Why is the variance being requested for the entire year? If the request is due to heat, and the ability to complete
the first hole maintenance early so the players can have an earlier tee time, then this would not be necessary for
the majority of the months due to sunrise/weather.
3. Timarron's argument that the lack of variance would somehow compromise the livelihood of their workers is a bit
insulting. They are a business, and as such can pay their workers whatever rate they want to. If Timarron say
their workers can only work for 4 hrs instead of 5 if they start at lam, there is nothing stopping Timarron from
increasing the hourly wage to compensate.
4. The statement made by Timarron that you cannot hear the machines being operated inside homes is simply
untrue.You can clearly hear machines and the headlights shine through our bedroom windows due to the
topography of the course. In fact, we heard them this morning, at approximately 6.10am, which I thought they
were not supposed to be doing while working through the variance process.
Additionally, who is the appropriate person to make a complaint under the ordinance as it stands? This morning, I wanted
to make a complaint due to the blatant disregard Timarron obviously have for the process by operating well before 7am;
however, I did not want to tie up PD resources on a noise complaint.

Jerod,
I have lived in Southlake and Timarron since 1998 and I am a social member of the
Timarron Country Club. I want to comment on the request by Timarron for a variance
or other relief from a local noise ordinance. Unfortunately, I was not able to attend a
recent Spin meeting where this topic was on the agenda.
I speak firmly against granting any noise variance in favor of Timarron. The Timarron
community is historically a quiet and peaceful residential neighborhood. Timarron
cannot establish any compelling or just reason for a variance. What has changed since
Timarron became a presence in our community? All necessary maintenance work can
be accomplished during the hours presently allowed. Indeed, nothing has changed
that would justify the imposition of increased noise from power equipment upon our
residents during expanded maintenance work hours. I believe Timarron should be
held to the standard established by current ordinance. A variance would disturb the
existing quality of the neighborhood that we selected precisely BECAUSE it offered
peace and quiet.
Please transmit this correspondence to the appropriate committee and to the City
Council if the matter is to be the subject of a vote. Thank you.

We live adjacent to 16th green at Timarron. Given current maintenance practices and equipment we would oppose
earlier than 7AM maintenance. We would not oppose, if the City required only low decibel, decibel level specified,

As Southlake residents who live in a home with a backyard that overlooks the Timarron
golf course, granting a permanent variance to allow for noise at 6:00 a.m. to awaken the
hundreds of Southlake residents that live within 200 feet of the golf course is offensive to
ordinary sensibilities. Granting the variance would interfere with public peace and
comfort, rendering citizens uncomfortable. In addition, our concern about this proposed
variance being "permanent" to allow for noise at 6:00 a.m. is a slippery slope that would set
a precedent for potential unintended consequences in the future. With no incremental tax
revenue being generated by this permanent variance request, the risk-adjusted return is
insufficient
Being abruptly awakened at 6:00 a.m. could especially be damaging to the health of the
elderly and school age children. Concern also arises for the would-be classroom
performance for students trying to manage both academic and school social pressures on
insufficient sleep. The CDC and NTH have both emphasized that adequate sleep contributes
to an individual's overall health and well-being and affirmed that sleep deprivation effects a
person's psychological state and mental health. Our current COVID-19 environment has
only heightened government concern regarding lasting psychological scars.
If granting the variance and its accompanying way -too -early annoying noise disruption
leads to golf course homeowner dissatisfaction, would their negative discourse be
propagated by social media that ultimately leads to reduced property values? If
neighboring communities have noise ordinances in force until 7:00 a.m., would
permanently changing Southlake's noise ordinance to 6:00 a.m. change our unofficial local
CISD motto to "Protect the Industrialization?"
