Cedar Oaks Addition (Lot 7, Block 1) - Permanent Utility Easementlim CITY OF SOUTHLAKE PUBLIC UTILITY EASEMENT THE STATE OF TEXAS COUNTY OF TARRANT KNOW ALL MEN BY THESE PRESENTS That We, Glosser, Truman et ux Debra ("Grantor"), for and in consideration of the sum of Ten ($10.00) Dollars and other good and valuable consideration in hand paid by Grantee, the receipt and sufficiency of which is hereby acknowledged and confessed, have granted, sold and conveyed, and by these presents do grant, sell and convey to the CITY OF SOUTHLAKE ("Grantee"), of Tarrant and Denton Counties, Texas a permanent and perpetual easement for the purpose of installing, repairing, maintaining, altering, replacing, relocating, and operating a sanitary sewer line and other public utilities in, into, upon, over, across and under that land in Tarrant County, Texas, described as follows, to -wit: A non-exclusive 20 foot wide permanent Public Utility Easement as more particularly described on Exhibit "A" attached hereto and shown on Exhibit "B" attached hereto, together with the right of ingress and egress as necessary for such purposes. Grantor covenants and agrees that Grantee shall have the right to excavate and fill upon said permanent easement and to remove from said permanent easement, any fences, buildings or other obstructions as may now be found upon said permanent easement. Grantor has this day additionally granted, sold and conveyed and by these presents does hereby grant, sell, and convey to Grantee an additional contiguous temporary construction easement for a period of one (1) year from the date the easement is filed of record with the County Clerk or until completion of the installation, for the purpose of installing utilities on the property known and described as follows, to -wit: 4 2 ! R 1"%22 A temporary 40 foot wide Construction Easement, said easement being located immediately adjacent to the above -described permanent easement in a configuration as shown on the attached Exhibit "B". Such Temporary easement shall include the right to excavate and fill upon said temporary easement, but Grantee shall replace any fences or other fixtures upon said temporary easement without cost to Grantor, and shall restore the grade of the property which is the subject of the temporary construction easement, as nearly as possible to it's grade prior to entry thereon. Grantor covenants and agrees that Grantor and Grantor's heirs, representatives, successors and assigns shall at no time erect, place or construct, or cause to be erected, placed or constructed any easements grated herein any temporary or permanent structure in, into, upon, over, across or under. TO HAVE AND TO HOLD the above -described permanent easement forever and the above described temporary easement for the period stated above, together with all and singular, the rights and appurtenances thereto, any wise belonging unto Grantee, it's successors and assigns; and We do hereby bind ourselves, our heirs and assigns, to warrant and to forever defend all and singular the premises unto the said Grantee, it's successors and assigns, against every person whomsoever lawfully claiming or to claim same or any part thereof.
