KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF TARRANT *
That NEWMARK HOMES, L. P., acting by and through its duly authorized officers
(Grantor) for and in consideration of the sum ofTEN DOLLARS ($10.00) and other good and
valuable consideration in hand paid by Grantee herein, the receipt and sufficiency of which is
hereby acknowledged and confessed, have granted, sold and conveyed, and by these presents do
grant. sell and convey to the CITY OF SOUTHLAKE, Grantee herein, of Tarrant County, Texas,
a perpetual utility & drainage easement in, into, upon, over, across and under a TEN (10) FEET
wide strip along the entire Southern property line of the following described lot in the MYERS
MEADOW, PHASE THREE a subdivision to the City of Southlake, Tarrant County, Texas,
including the right of ingress and egress for the purpose of maintaining the easement, as follows, to-
wit:
Lot 21, Block 8, MYERS MEADOW, PHASE THREE, an Addition to the City of
Southlake, Tarrant County, Texas, according to plat recorded in Cabinet A, Slide 3428/3429,
Deed Records, Tarrant County, Texas.
as further described on Exhibit "A" attached hereto and made a part hereof for all purposes. ~
The CITY OF SOUTHLAKE further agrees to allow the property owner to extend
the current retaining wall, encroaching no more than lour feet (4') into the aforementioned easement. ~
TO HA VE AND TO HOLD said Easement unto the CITY OF SOUTHLAKE, its
successors and assigns, and Grantor hereby binds itself, its successors and assigns to warrant and
forever defend, all and singular, said premises unto the CITY OF SOUTHLAKE, its successors
and assigns, against every person whomsoever lawfully claiming or to claim the same or any part
thereof.
The terms of this dedication shall run with the land and shall be binding upon and
inure to the benefit of the CITY OF SOUTHLAKE and its successors and assigns.
