Myers Meadow Phase 1 (Lot 5, Block 5) - Landscape Easement r ,- ()FFICiAL '.< / ) c.....- CITY OF SOUTHLAKE LANDSCAPE EASEMENT THE STATE OF TEXAS § § COUNTY OF TARRANT § KNOW ALL MEN BY THESE PRESENTS: That we, Michael P. McClanahan and Brenda K. McClanahan, Grantor herein, for and in consideration of the planting of trees by Grantee as described below and other good and valuable consideration in hand paid by Grantee, the City of Southlake, Texas, a home-rule municipal corporation of the County of Tarrant, State of Texas, the receipt and sufficiency of which is hereby acknowledge and confessed, do hereby grant, sell, and convey to the City of Southlake, its successors and assigns, a permanent and perpetual easement for the purpose of allowing Grantee to plant and inspect trees adjacent to the adjoining street right-of-way on the land in Tarrant County, Texas, described as follows, to-wit: A Permanent 20 foot Wide Landscape Easement more particularly described in Exhibit" A" attached hereto. Together with the right of ingress and egress as necessary for such purposes. After initial planting of the trees by the Grantee, Grantor shall be responsible for and agrees to perform all maintenance necessary to keep the trees in a healthy and living condition. Grantee shall have the right to enter upon the Grantor's property for the purpose of performing inspections of the trees to determine weather such trees are healthy and being properly maintained. Grantor convenants and agrees that Grantor and Grantor's heirs, representatives, successors and assigns shall at no time erect, place or construct, or cause to be erected, placed or constructed in, into, upon, over, across or under any easements granted herein any temporary or permanent structors, and it is further agreed that Grantee shall have the right to excavate and fill upon the permanent easement and to remove from the permanent easement, any fences, buildings or other obstructions as may now exist upon the easement. TO HAVE AND TO HOLD the above-described easement, together with all and singular, the rights and appurtenances thereto, anywise belongings unto the said Grantee, its successors and assigns forever; we do hereby bind ourselves, our heirs and assigns, to warrant and to forever defend all and singular the premises unto the said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim same or any part thereof.
