20-020 RESOLUTION NO. 20-020 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS AUTHORIZING THE FILING OF A PROJECT APPLICATION FOR THE COVID-19 RESPONSE AND MITIGATION PROJECT WITH THE PUBLIC SAFETY OFFICE OF THE STATE OF TEXAS (PSO) FOR THE CORONAVIRUS EMERGENCY SUPPLEMENTAL FUNDING GRANT FUNDED BY THE FEDERAL GOVERNMENT THROUGH THE EMERGENCY APPROPRIATIONS FOR CORONOVIRUS HEALTH RESPONSE AND AGENCY OPERATIONS, WHICH WAS MADE AVAILABLE THROUGH A CONGRESSIONAL APPROPRIATION TO THE U.S. DEPARTMENT OF JUSTICE, BUREAU OF JUSTICE ASSISTANCE; AUTHORIZING ALISON ORTOWSKI, ASSISTANT CITY MANAGER, TO ACT ON BEHALF OF THE CITY OF SOUTHLAKE IN ALL MATTERS RELATED TO THIS APPLICATION; PLEDGING THAT IF FUNDING FOR THIS PROJECT IS RECEIVED, THE CITY OF SOUTHLAKE WILL COMPLY WITH ALL GRANT REQUIREMENTS; AND PLEDING THAT IN THE EVENT OF LOSS OR MISUSE OF GRANT FUNDS, THE CITY OF SOUTHLAKE WILL RETURN ALL FUNDS TO THE PSO. WHEREAS, Congress passed the Coronavirus Aid, Relief, and Economic Security (CARES) Act of 2020 and President Trump signed it into law on March 27th, 2020, to provide economic relief and protect the American people from the public health and economic impacts of COVID-19; and, WHEREAS, Federal Funds are authorized under Division B of H.R. 748, Pub. L. No. 116136 (Emergency Appropriations for Coronavirus Health Response and Agency Operations); 28 U.S.C. 530C. Coronavirus Emergency Supplemental Funding (CESF) is made available through a Congressional appropriation to the U.S. Department of Justice, Bureau of Justice Assistance; and, WHEREAS, the State of Texas received Federal Funds through the U.S. Department of Justice, Bureau of Justice Assistance, for the response and mitigation to the Coronavirus, and expects to make approximately $37.8 million of grant funding available to counties and cities through the State's Public Safety Office's Criminal Justice Division for local projects that seek to prevent, prepare for, and respond to the coronavirus; and, WHEREAS, the City of Southlake is applying for assistance for its First Responders and Courts and may also accept additional funds that may become available at a later date; and, Page 1 of 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: SECTION 1. Alison Ortowski, Assistant City Manager, or her designee is authorized to request grant project funding under the Coronavirus Emergency Supplemental Funding (CESF) Program, FY2020, and act on behalf of the City of Southlake in all matters related to the grant application and any subsequent project contract that may result. SECTION 2. The City of Southlake shall submit an application for CESF funding made available through the State of Texas Public Safety Office (PSO) for the COVID-19 Response and Mitigation Project. SECTION 3. The City of Southlake intends to comply with all agreed upon contractual requirements of the CESF Program and other federal and state law including all applicable matching requirements. SECTION 4. The City of Southlake shall return all funds to the PSO in the event of loss or misuse of grant funds. SECTION 5. This Resolution shall take effect upon its adoption and it is so Resolved.
