PROJECT: Sign Variance for Crescent Heights
EXECUTIVE
SUMMARY: Hat Creek Development is requesting approval of variances to Sign Ordinance
No. 704, as amended, to allow two temporary residential development signs
beyond the 1-year limit of the sign ordinance and to allow a larger sign face
area than allowed for each sign. Crescent Heights is addressed at 216 Legacy
Court and 908 Stacy Drive, Southlake, Texas.
REQUEST
DETAILS: The Crescent Heights subdivision is generally located on the northwest
intersection of Shady Oaks Drive and W. Southlake Boulevard.
The applicant is requesting a variance to allow two existing temporary
residential development signs to remain until the issuance of a Certificate of
Occupancy for all buildings in the subdivision. The sign permits were issued in
September and October 2018 and have since expired. Development signs are
allowed with a sign permit for 1-year of erection of the sign or upon issuance of a
C.O. for all buildings on the site.
The two temporary development sign faces were replaced without a permit and
do not currently meet the sign area regulation. The originally approved sign
faces (24 sf, 4 ft. by 6 ft.) were replaced with the current sign faces (30 sf, 6 ft.
by 5 ft.).

BACKGROUND INFORMATION
APPLICANT: Hat Creek Development
PROPERTY SITUATION: 216 Legacy Court and 908 Stacy Drive, Southlake, Texas.
LEGAL DESCRIPTION: Open Space Lot 1, Block A addressed 908 Stacy Drive and Open
Space Lot 2, Block A addressed at 216 Legacy Court
CURRENT ZONING: “R-PUD” Residential Planned Unit Development
HISTORY: June 6, 2017; A Zoning Change and Development Plan for Crescent
Heights with fifty-seven (57) residential lots and eleven (11) open space
lots on approximately 57.95 acres was approved by City Council. (ZA17-
016)
November 7, 2017; A Preliminary Plat for Crescent Heights with fifty-
seven (57) residential lots and eleven (11) open space lots on
approximately 57.95 acres was approved by City Council. (ZA17-077)
April 17, 2018; City Council approved a plat revision for Crescent
Heights on the consent agenda (6-0). (ZA18-020)
The Crescent Heights temporary development sign permits were issued
September 26, 2018 (SIGN18-00090) and October 1, 2018 (SIGN18-
00082). The sign permits expired in September 27, 2019 and June 17,
2019 respectively.
STAFF COMMENTS: City Council approval of the request does not eliminate the requirement
for an appropriate sign application submittal prior to sign installation.

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize variances to any
restriction set forth in this ordinance, including but not limited to the
number, type, area, height, or setback of signs, or any other aspect
involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall consider
the following criteria:
(i) Special conditions exist which are peculiar to the land, structure or
building involved and are not applicable to other lands, buildings or
structures in the same zone. The City may attach such conditions
to granting all or a portion of any variance necessary to achieve the
purpose of this ordinance, and;
(ii) The strict interpretation of the provisions of the ordinance would
deprive the applicant of rights commonly enjoyed by other
properties in the same zone under the terms of the ordinance, and;
(iii) The special conditions and circumstances do not result from the

actions of the applicant and such conditions and circumstances do
not merely constitute pecuniary hardship or inconveniences, and;
(iv) Granting the variance will meet the objectives of the ordinance and
not be injurious to the adjoining property owners or otherwise
detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to alleviate
the special hardship or practical difficulties faced by the applicant in
meeting the requirements of this ordinance; and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s). Any
modification of the signage approved by the variance or the
installation of new or replacement signage that does not meet the
specific requirements of the City Council variance approval is
prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to the
Administrative Official and be accompanied by a completed application and a
non-refundable filing fee in the amount specified in the current fee schedule
adopted by City Council. The sign variance will be considered by the City
Council following a recommendation by the Sign Board. The Sign Board’s
recommendation will be forwarded to the City Council for their consideration.
