Item 8ACase No. SV20-0003 S T A F F R E P O R T April 14, 2020 CASE NO: SV20-0003 PROJECT: Sign Variance for Banyan Court Capital EXECUTIVE SUMMARY: Priority Signs and Graphics, on behalf of Montage Development Group, is requesting approval of a variance to allow a larger that permitted letter height and Sign Ordinance No. 704, as amended to allow an upper story attached building sign. The tenant, Banyan Court Capital, is located at 151 Players Circle, Southlake, Texas. REQUEST DETAILS: Banyan Court Capital is located on the second floor of the office building on the east side of Players Circle, 250-feet from the intersection of Players Circle and W. Southlake Blvd. The Banyan Court Capital occupies the entire second floor of the building. The proposed sign will be located above the northwest second floor windows on the west elevation facing Players Circle. There are currently no signs on the building. In Sign Ordinance No. 704-J, upper story signs are prohibited unless approved by City Council as part of a Master Sign Plan or variance. The proposed attached building sign qualifies as an upper story sign and is congruent to the tenant’s lease space. The proposed sign meets all other sign ordinance criteria regarding area, letter type and illumination. Non-illuminated signs: Letters: 2-inch depth white- faced channel letters (main sign) with 2-inch flat cut acrylic letters for tag line Logo to be white, green and grey 2-inch channel Case No. SV20-0003 At the March 5, 2020 Sign Board meeting, the Sign Board was concerned with additional signs on the building and asked staff to determine whether a monument sign could be placed on the property for additional tenant signage. Since the meeting, staff has confirmed that a monument sign may be placed on the property in the Conditional Sign Permit for Players Circle (SP05-210) allowing a monument sign on each lot. The monument signs have two allowable sizes and must be placed 15-feet from the property line. Currently, there are 2 existing monument signs located at 170 and 201 Players Circle as well as a tenant tower monument sign located at 1957 Players Circle. For 151 Players Circle, locating a monument sign 15-feet off the property line may be challenging due to the existing parking lot location. April 19, 2005; City Council approved a Zoning Change and Concept Plan and a Preliminary Plat for this and other lots within Players Circle (ZA05-010 and ZA05-011). A Final Plat was approved by the Planning & Zoning Commission on September 8, 2005 and filed with Tarrant County on March 28, 2006. (ZA05-084) September 20, 2005, City Council approved a Conditional Sign Permit for Players Circle Addition for one principle monument sign at the southwest corner of the intersection of Players Circle and W. Southlake Blvd. and a standard monument sign on Lot 9 to be shared with Lot 8 along W. Southlake Blvd. Additionally, each lot would be allowed one monument sign per the City Council motion and the conditional sign permit regulations.(SP05-210) February 21, 2006: City Council approved a sign variance for Stampede Sports on the north side of the building (which does not directly face a drive or street, but has with visibility to W. Southlake Blvd.), allowing a 24-inch letter height (where 12-inches is permitted), and a sign width of 32’-5” (where 31’-11” is permitted) November 4, 2014; City Council approved a site plan for Lot 2, Block 1 Players Circle Addition (ZA14-123) SIGN BOARD: March 5, 2020; Approved (6-0) subject to the Staff Report dated February 28, 2020 and granting the variance as requested and subject to the current placement of the sign as shown; allowing only one sign on the building; and requiring a sign variance for any additional attached building signs on this building. Case No. Attachment A SV20-0003 Page 2 CITY COUNCIL: March 17, 2020; On the Consent Agenda, City Council approved (5-0) the tabling of the item to a future meeting. STAFF COMMENTS: City Council approval of the request does not eliminate the requirement for an appropriate sign application submittal prior to sign installation. Variance Criteria: 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application Case No. Attachment A SV20-0003 Page 3 and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
