PROJECT: Sign Variances for the Stony Brook Residential Development
EXECUTIVE
SUMMARY: Creekside Land Company, Ltd., is requesting approval of variances to Sign
Ordinance No. 704, as amended, to allow a previously approved temporary
residential development sign to remain and for a variance to a subdivision entry
monument sign. The Stony Brook residential development is located at 102 Stony
Brook Way, Southlake, Texas.
REQUEST
DETAILS: The Stony Brook residential development is located on the south side of W.
Southlake Blvd. approximately 860 feet east of the intersection of Watermere Drive
and W. Southlake Blvd. In Sign Ordinance No. 704-J, as amended, the developer is
allowed a subdivision entry monument sign at each entrance and a temporary
residential development sign for a period of the earlier of one year or issuance of a
certificate of occupancy for all buildings.
The City Council approved the zoning change and development plan for the Stony
Brook to develop 47 residential lots and 8 open space lots on March 7, 2018 (ZA17-
064 and Ordinance No. 480-730 with “R-PUD” zoning). In the Ordinance motion, the
entry features (monument sign and guard house) were approved with stone and
bronze materials as presented at the City Council meeting. The entry monument
sign deviates from the rendering presented at the City Council meeting and will
require a sign variance.
The temporary development sign was originally approved on December 27, 2018.
has since expired. The applicant is requesting a sign variance to allow the sign to
remain on the property until September 30, 2020 due to construction delays. The
sign is compliant with the ordinance except for the expiration of the originally
approved sign permit.
The applicant is also requesting approval of a variances for the proposed subdivision
entry monument sign to allow a sign face height of 5 feet where the allowable sign
face height is 4 feet and the 6-inch required brick, stone, or masonry around the sign
face. The design of the sign includes a sign face of Corten steel that is not
surrounded by the required brick, stone, or masonry. The subdivision monument
sign meets all remaining requirements of the Sign Ordinance.

BACKGROUND INFORMATION
APPLICANT/OWNER: Creekside Land Company, Ltd.
PROPERTY SITUATION: 102 Stony Brook Way, Southlake, Texas
LEGAL DESCRIPTION: Lots 2X and 7X, Block 1, Stony Brook
HISTORY: The property was annexed into the City in 1956.
A Plat Showing for Brock Addition was filed November 8, 1967.
The “SF-1A” Single Family Residential District zoning was placed on the
Brock Addition property with the adoption of Ordinance No. 480 and the
Official Zoning Map in September of 1989.
A Plat Revision for Lots 1R and 3R, Brock Addition was approved September
2, 1997 and filed November 21, 1997.
August 2, 2016A; City Council denied a Zoning Change and Development
Plan and the associated Preliminary Plat for Stone Trail Estates from “AG”
Agricultural District and “SF-1A” Single Family Residential District to “R-
PUD” Residential Planned Unit Development for Stone Trail Estates to
develop 61 residential lots and 12 open space lots on approximately 36.03
acres. (ZA15-153 and ZA15-125)
March 6, 2018; City Council approved a Zoning Change and Development
Plan from “AG” Agricultural District and “SF-1A” Single Family Residential
District to “R-PUD” Residential Planned Unit Development for Stony Brook
to develop 47 residential lots and 8 open space lots on approximately 34.73
acres and the associated Preliminary Plat. (ZA17-064 and ZA17-066)
December 27, 2018; a temporary development sign for the Stony Brook
development was issued and valid for 1-year. (SIGN18-0275)
February 10, 2020; a Plat Revision was filed under Instrument No.
D220032281.
STAFF COMMENTS: Note: The proposed ground lighting where the light itself and supporting
structure are not visible from the ROW. Provide screening to meet this
requirement.
City Council approval of the proposed signs does not eliminate the
requirement for appropriate sign application submittal prior to the installation

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize variances to any
restriction set forth in this ordinance, including but not limited to the
number, type, area, height, or setback of signs, or any other aspect
involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall
consider the following criteria:
(i) Special conditions exist which are peculiar to the land, structure
or building involved and are not applicable to other lands,
buildings or structures in the same zone. The City may attach
such conditions to granting all or a portion of any variance
necessary to achieve the purpose of this ordinance, and;
(ii) The strict interpretation of the provisions of the ordinance would
deprive the applicant of rights commonly enjoyed by other
properties in the same zone under the terms of the ordinance,
and;
(iii) The special conditions and circumstances do not result from the
actions of the applicant and such conditions and circumstances
do not merely constitute pecuniary hardship or inconveniences,
and;
(iv) Granting the variance will meet the objectives of the ordinance
and not be injurious to the adjoining property owners or otherwise
detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to alleviate
the special hardship or practical difficulties faced by the applicant
in meeting the requirements of this ordinance; and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s). Any
modification of the signage approved by the variance or the
installation of new or replacement signage that does not meet the
specific requirements of the City Council variance approval is
prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to the
Administrative Official and be accompanied by a completed application and
a non-refundable filing fee in the amount specified in the current fee schedule
adopted by City Council. The sign variance will be considered by the City
Council following a recommendation by the Sign Board. The Sign Board’s
recommendation will be forwarded to the City Council for their consideration.
