PROJECT: Sign Variances for Havertys Furniture
EXECUTIVE
SUMMARY: Mcmillan Pazdan Smith Architecture, on behalf of Havertys Furniture Companies,
Inc., is requesting approval of variances to Sign Ordinance No. 704, as amended,
for Haverty's Furniture located at 250 N. Kimball Avenue, Southlake, Texas.
DETAILS: The new Havertys store is locating in the existing building that Toys -R -Us and
Babies -R -Us previously occupied which is generally on the northwest corner of
Kimball Avenue and the eastbound SH114 Frontage Road.
Southlake Corners currently has a Master Sign Plan (MSP) (SP04-050) in place that
includes specific signage approvals for Circuit City which was the tenant at this
location prior to Toys -R -Us and Babies -R -Us. With that MSP, maximum letter/logo
height and sign area criteria were also put in place for any future anchor tenant
occupying 20,000 square feet or greater.
When Toys -R -Us / Babies -R -Us came through in 2011 (SV11-002), they were
granted variance approval to exceed the maximum allowed letter height.
Currently, although the proposed signs for Havertys meet the MSP maximum
letter/logo height and sign area, they are proposing signage criteria that is not
addressed under the MSP which defaults the variances to Ordinance No. 704, as
amended. Specifically, the applicant is requesting to install an illuminated border
around portions of the building; three (3) attached building signs with blue face lit
letters and white LED halo illumination (dual lit) (Signs A, B1 & 132); the north and

B2); and, illuminated non -conforming signage on all three (3) existing development
monument signs (Signs F1 -F6).
On February 6, 2020, the Sign Board recommended approval (5-1) acknowledging
the removal of the placement variance for signs B1 & B2 and approving all other
variances as presented.

BACKGROUND INFORMATION
APPLICANT: Mcmillan Pazden Smith Architecture
OWNER: RPAI Southwest Management LLC — Havertys Furniture Companies, Inc.
PROPERTY SITUATION: 250 N. Kimball Avenue
HISTORY: The Southlake Corners Conditional Sign Permit (SP04-050) was approved
by City Council on April 6, 2004. The MSP included specific signage for
Circuit City.
Variances were approved for Toys -R -Us / Babies -R -Us (SV11-002)
allowing for attached building signage that exceeded maximum allowed
letter height and maximum sign width.
Variance was approved for Home Goods (SV11-017) allowing for an
attached building sign to exceed the middle 75% of the single plane
fagade.
SIGN BOARD: February 6, 2020; Approved (5-1) (Springer) subject to the updated Staff
Report dated February 6, 2020 and as presented. Commissioner Springer
cast a dissenting vote because he felt the additional signage on the existing
monument signs was too much.
STAFF COMMENTS: City Council approval of the proposed sign does not eliminate the
requirement for appropriate sign application submittal prior to the installation
of the sign. Please contact Seantay Carpenter at 817-748-8215 or

VARIANCE CRITERIA: 9.6.2 VARIANCES
Variance Authorized. The City Council may authorize variances to any
restriction set forth in this ordinance, including but not limited to the
number, type, area, height, or setback of signs, or any other aspect
involved in the sign permitting process.
Approval Standards. In granting any variance, City Council shall
consider the following criteria:
(i) Special conditions exist which are peculiar to the land, structure
or building involved and are not applicable to other lands,
buildings or structures in the same zone. The City may attach
such conditions to granting all or a portion of any variance
necessary to achieve the purpose of this ordinance, and;
(ii) The strict interpretation of the provisions of the ordinance would
deprive the applicant of rights commonly enjoyed by other
properties in the same zone under the terms of the ordinance,
and;
(iii) The special conditions and circumstances do not result from the
actions of the applicant and such conditions and circumstances

do not merely constitute pecuniary hardship or inconveniences,
and;
(iv) Granting the variance will meet the objectives of the ordinance
and not be injurious to the adjoining property owners or otherwise
detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to alleviate
the special hardship or practical difficulties faced by the applicant
in meeting the requirements of this ordinance; and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s). Any
modification of the signage approved by the variance or the
installation of new or replacement signage that does not meet the
specific requirements of the City Council variance approval is
prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to the
Administrative Official and be accompanied by a completed application and
a non-refundable filing fee in the amount specified in the current fee schedule
adopted by City Council. The sign variance will be considered by the City
Council following a recommendation by the Sign Board. The Sign Board's
recommendation will be forwarded to the City Council for their consideration.
