Carroll Avenue October 11, 1988 Page 2 Special City Council Meeting October 11, 1988 7:30 p.m. Ralph Caster - 3520 Burney Lane, Tract 30. What is the city tax rate. He would like city water if brought into the city. He has Present: Mayor Pro Tem, Betty Springer; Councilmembers: Jim no problems being in the city if we can do what we say we will do. Wooll, Sally Hall, Ralph Evans and Pam Muller Kitty Caster - passed. Absent: Mayor, Johnny H. Westerholm Robert Armstrong — 3535 Burney Lane, Tract 30. He is opposed to City Staff Present: City Manager, Curtis E. Hawk; Director of annexation. The only thing we can offer him is police protection Public Works, Bill LeGrand; City Engineer, Eddie Cheatham; City and he is not satisfied with that anyway. Attorney, Adrienne Leonard and Legal Assistant Toni Chamberlain. Jannice Johnson - Rt. 1 Box 224, Roanoke, Texas. She does not want to be a part of Southlake. She feels annexation should be by Invocation - Sally Hall choice of each property owner. It is not the money but the idea that bothers her. Agenda Item #1, Call to Order The meeting was called to order by Mayor Pro Tem, Betty Springer. She announced that this is the 1st. public hearing for annexation of several tracts of land. Curtis Hawk, City Manager, stated the reasons why cities get into annexation. When property is annexed, the City assumes the responsibility to provide services to the residents of those areas and the services include: 24 hour police and fire protections, emergency management services, traffic control, planning and zoning, code administration, inspection services and other kinds of city services. Annexation is simply not something that is done to expand the cities limits and not done just to expand tax base, its done to protect the community at large, to exercise our police power of control at the cities fringes. The purpose of annexation is to give the city the opportunity to control the unchecked kind of growth that will ultimately take place on the cities fringes that at some time could become a burden to the city. Agenda Item #2, Public Hearing: B.J. Couch - 2535 Union Church, Tract 13B. He does not want to be annexed and presently has all the services Southlake can offer. Southlake cannot afford what it has, we don't need anymore area or people. He is not satisfied with the City Councils' view points on a freeway through Southlake. Springer stated, we will soon be upgrading the staff in the police department. The merger committee is a feasibility study to look into the pros and cons of a merger of the two cities. The city has agreed by resolution to enter into a study with CONET in regards to an east -west freeway in our area. M.L. McIntire - 3530 Burney Lane, Tract 30. What can we offer him that he doesn't already have. He would be happy if we could get his children in the Carroll Independent School District. He does not want to be in the city at this time. David Conn - #13 Sutton Place, Tract 16. He thanked the city for the courtesy notice of the public hearings. He still does not want to be in the city. Southlake's police is not up to par, and the fire department is too far away to get any help in time. He feels it was a big waste of money to relocate the water tower on Florence Road. He knows that if the city doesn't make improvements by a certain length of time, he can disannex his land. Royal Smith - Johnson Road, Tract 14 and 16. He reviewed historical fact on Southlake and Keller, concerning gas, electric, water, streets. He stated he has had nothing but trouble from Southlake through the years. He doesn't want any. He wants to suggest his farm on Johnson Road stay in the county. We will provide him nothing but a tax bill. Carl Fretwell - 3400 N. E. 28th St. Fort Worth. He farms the land being considered for annexation and does not want to be annexed. He is a grandson of Bob Jones. He wants to be left alone. Prays to God we will not include his land in Southlake. Once the land is in the city, he will loose jurisdiction over it. JoAnn Scamado - 2159 Southlake Park Road, Tract 26. She already pays city taxes on her house and lot, her acreage is in Denton County. She doesn't want to be in Southlake, she cannot pay the d taxes. John Meeks - 5629 Coulen Drive, Fort Worth, Tract 31E3. He is a great great grandson of Bob Jones. He is also opposed to annexation. He does not farm his land but he just wants to keep it, and does not want to be taxed out of it. The Public Hearing was closed. Mayor Pro Tem Springer announced that the second public hearing will be held on October 18 at 7:30 p.m. 5peciai uicy uou October 11, 1988 Page 3 Agenda Item #3. Executive Session Executive Session: Personnel matters pursuant to Article 6252-17, Section 2, V.T.A.S. the Texas Open Meetings Law. The City Council convened in executive session at 8:45 p.m. to discuss the evaluation, appointment, and employment of the City Attorney, and also to consider authorizing the City Manager to employ special counsel of his choice to assist in personnel matters. The City Council reconvened in open session at 9:35 p.m. Agenda Item #4. Consider Action Re: City Attorney Mayor Pro Tem Springer announced that the City Council did discuss the evaluation, appointment, and employment of the City Attorney. Also, that we have in hand a letter of resignation from the current: City Attorney, Mr. John Boyle and firm, and at this time will entertain a motion in regards to potential employment of a future attorney firm. Motion was made to form a committee of Jim Wooll and Sally Hall to interview potential city attorneys. Motion: Wooll Second: Muller Ayes: Wooll, Muller, Springer, Hall and Evans Nays: None Approved: 5-0 Agenda Item #5. Consider Action Re: Special Counsel A discussion was held concerning action necessary regarding the authorization of the City Manager to employ special counsel of his choice to assist in personnel matters. Motion was made for the City Manager to look for and bring back a recommendation for special counsel for the purpose of assisting in personnel matters. Motion: Wooll Second: Evans Ayes: Wooll, Evans, Hall, Muller and Springer Nays: None Approved: 5-0 Public Comments: Bill Low - 3111 Woodland Trail. He stated several months ago he was critical of John Boyle's firm in the handling of the police Special City Council Minutes October 11, 1988 Page 4 Public Comments continued matter. Now he feels it was certain Councilmembers and city staff that did not follow his advise. He apologies for Boyle's firm. Jim Martin - passed. There being no further business, the meeting was adjourned.
