Call to order: Board President Bob Mundlin called the February 12, 2013 CCPD meeting to order at 6:31 p.m. Agenda Item No. 2. Executive Session No executive session Agenda Item No. 3. Public Forum: No one from the public was present for Public Forum CONSENT AGENDA: All items listed below are considered routine by the Southlake Crime Control and Prevention District Board and will be enacted with one motion. There will be no separate discussion of items unless a Board member or citizen so requests, in which event the item will be removed from the general order of business and considered in its normal sequence. Agenda Item No. 5. Consent: A. Approve the minutes of the Crime Control and Prevention District Board Meeting held on December 11, 2012. Approval of the minutes of the Crime Control and Prevention District Board Meeting held on December 11, 2012 was tabled to the next meeting. B. Approve the minutes of the Crime Control and Prevention District Board Meeting held on January 17, 2013. Approval of the minutes of the Crime Control and Prevention District Board Meeting held on January 17, 2013 was tabled to the next meeting. REGULAR AGENDA: Agenda Item No. 6. Discussion: A. Crime Control Prevention District Sales Tax Update Board Treasurer Sharen Jackson gave the update on the sales tax collections. Ms. Jackson reported that sales tax collections during the Holiday Season for fiscal year 2013 were slightly below 10% better than the prior Holiday Season, and 13.5% above collections during the Holiday Season 2 years ago. Year to date sales tax collections are $138,000.00 above budget. Ms. Jackson addressed questions from the Board. B. Update on Construction of North DPS Facility North DPS Construction Manager Peter Kao gave the update on construction of the North DPS Facility. Mr. Kao reported that the state of North DPS is good, project is at 40% completion and it is under budget. Due to cost, a decision was made to place the data room at DPS Headquarters and to place the data recovery room at North DPS Facility. Mr. Kao reported that a request for solar panels is not an option at this stage in the project. Lee Lewis has begun interior wall placement, plumbing and HVAC. The firing range roof is on and all the walls are in place. Mr. Kao reported that tours of the North DPS Facility would be scheduled soon. Mr. Kao addressed questions from the Board. Agenda Item No. 7. Consider: A. Authorize publication of Notice of Public Hearing to undertake project Sharen Jackson reported that bonds are to be issued in the Spring for the completion of the North DPS Facility. This item authorizes the publication of Notice of Public Hearing in the newspapers for bond sale, to allow citizens the opportunity to attend the Public Hearing to discuss the project that the Board is undertaking. The Public Hearing will be held in the March 2013 meeting. Ms. Jackson addressed questions from the Board. Adjourn: Board President Bob Mundlin entertained a motion to adjourn Motion: Ken McMillan Second: Robert Williams Ayes: McGuire, McMillan, Powers, Mundlin, Williams and Sturtevant Nays: None Approved: 6-0 The meeting adjourned at 6:49 p.m. Melissa Mensch, Board Secretary 'gob City of Southlake Crime Control & Prevention District Meeting Agenda EXECUTIVE SESSION Southlake Crime Control and Prevention District Board SECTION 551.071 CONSULTATION WITH ATTORNEY The Southlake Crime Control and Prevention District Board may conduct a private consultation with its attorney when the Board seeks the advise of its attorney concerning any item on this agenda, about pending and contemplated litigations, or a settlement offer, or on a matter in which the duty of the attorney to the Southlake Crime Control and Prevention District Board under the Texas Disciplinary Rules of Professional Conduct of the State Board of Texas clearly conflicts with Chapter 551. SECTION 551.072 DELIBERATION REGARDING REAL PROPERTY The Southlake Crime Control and Prevention District Board may conduct a closed meeting to deliberate the purchase, exchange, lease or value of real property. SECTION 551.073 DELIBERATION REGARDING PROSPECTIVE GIFT The Southlake Crime Control and Prevention District Board may conduct a closed meeting to deliberate a negotiated contract for a prospective gift or donation to the City. SECTION 418.183(F): TEXAS DISASTER ACT The Southlake Crime Control and Prevention District Board may conduct a closed meeting to deliberate information: 1) for purposes of preventing, investigating, or responding to an act of terrorism or related criminal activity and involving emergency response providers, their staffing, contact information and tactical plans; 2) that relates to the risk or vulnerability of persons or property, including infrastructure, to an act of terrorism; 3) that relates to the assembly of an explosive weapon, the location of a material that may be used in a chemical, biological or radioactive weapon, or unpublished information pertaining to vaccines or devices to detect biological agents or toxins; 4) that relates to details of the encryption codes or security keys for a public communication system; 5) that relates to a terrorism -related report to an agency of the United States; 6) that relates to technical details of particular vulnerabilities of critical security systems intended to protect public and private property from an act of terrorism. The Texas Disaster Act specifically requires that a tape recording of the closed meeting be made. A final action, decision, or vote on a matter deliberated in a closed meeting may only be made in open session.
