KNOW ALL MEN BY THESE PRESENTS:

the recei pt and sut1iciency of which is hereby acknowledged and confessed, have granted,
sold and conveyed, and by these presents do grant, sell and convey to the CITY OF
SOUTH LAKE, Grantee herein, of Tarrant Cour.ty, Texas a permanent and perpetual
drainage easement for the purpose of constructing and maintaining said drainage
improvements upon, over. across and under that land in Tarrant County, Texas described as
follows. to-wit:
Being a 20-[t wide permanent drainage easement and an additional 30-ft wide temporary
construction easement, described as follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
Such permanent easements shall include the right to enter for purposes of maintaining the
drainage improvements upon such property, but Grantee shall replace any fences,
improvements, or other fixtures upon said property without cost to Grantor, or current owner
thereof and shall restore the property. the subject of the permanent easement, as nearly as
possible to its condition prior to entry thereon,
10 I-lAVE AND TO HOLD the above described easement, together with all and singular,
the rights and appurtenances thereto, anywise belonging unto the said Grantee, its successors
and assigns forever; and IIWe do hereby certify that I/We is/are the owner(s) of the property
described herein and bind myself/ourselves, my/our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said Grantee, its successors and assigns,
against every person whomsoever lawfully claiming or to claim same or any thereof.

Being 0.1977 of an acre of land, more or less, situated in the Francis Throop Survey,
Abstract No. 1511, City of Southlake, Tarrant County, Texas and being a portion of Lot 1
Block 2. TWll1 Creeks Addition, an addition to the City of Southlake as recorded in
Volume 388-150 Page 74, Plat Records of Tarrant County, Texas (P.RT.C.T.), and
further being a portion of a tract conveyed to Lyndon Ray Smith by deed in Volume
12054, Page 2211 (D.R.T,c.T.), of which 0.1977 of an acre ofland, more or less, is more
particularly described as follows:
COMMENCING at an iron pin in the right-of-way of County Road #3080 (Dove Road)
at the Southeast corner of a certain 1.11 Acre tract of land conveyed from Leona Tanner
to the First Baptist Church of Southlake and recorded in Volume 4360, Deed Records
(arrant County Texas (D.R.TCT.), said iron pin being by a previous description 560.7
feet West and 2813.5 feet South 01030' West from the most westerly southwest corner of
