In accordance with Chapter 212.0093 of the Texas Local Government Code, on
January 24, 2020 the applicant filed a response to the City Council's October 15,
2019 disapproval of the Plat Revision and is seeking approval to divide one
residential lot into two residential lots. In accordance with Chapter 212.0095,
Texas Local Government Code, the City Council must approve or disapprove the
plat not later than the 15th day after the filing of the response.

Proposed Plat Revision Plat I
1. Subdivision Ordinance No. 483, as amended, Sections 8.01(A) and 5.04, require that every
lot shall front on a public street (which includes public utilities). The applicant is requesting
approval of a variance to allow the lot to be accessed by a private driveway with a private
water line.
2. Subdivision Ordinance No. 4831 section 5.06 requires minimum 5' sidewalks along both
sides of all public and private streets. No sidewalks are proposed.

Texas Local Government Code Section 212.015, Additional Requirements for
Certain Replats, Subsection (c)
If the proposed replat requires a variance and is protested in accordance with this
subsection, the proposed replat must receive, in order to be approved, the
affirmative vote of at least three-fourths of the members present of the municipal
planning commission or governing body, or both. For a legal protest, written
instruments signed by the owners of at least 20 percent of the area of the lots or
land immediately adjoining the area covered by the proposed replat and extending
200 feet from that area, but within the original subdivision, must be filed within the
municipal planning commission or governing body, or both, prior to the close of the,
