Item 4I - Demonstration PagesVARIANCE REQUESTED - LETTER HEIGHT LESS THAN OR EQUAL TO 12" - SIGNS A, C Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. The name of the restaurant 'MOXI ES' is short, therefore if the 12" maximum height restriction is applied to the letters, our logo signs will be too small to be legible and effective. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. MOXIES is a national chain that seeks cohesiveness in its brand identity. We design the signage to conform to the proportional requirements of the brand and logo. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. Although we are asking for a variance of 24" tall letters for the logo only, the overall area and quantity of signs is not incompatible with the sign regulations and the overall proportion of the sign to the building facades is not excessive or out of scale with the character of the development. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. The building identification sign, although taller than allowed by regulation, will be mounted low on the patio in order to enhance the urban 'downtown' character of the town square. In this position it will not be a nuisance to any adjacent property given that it does not have face illumination. The canopy fascia sign speaks to the intersection of Central and Main Street to which we are adjacent and is auto -oriented. Although taller than allowed by regulation, the larger sign will be well designed and pleasing in appearance and will be integral to the design of the luxury patio dining space that we will build on this corner. The patio and sign together will be a beautiful amenity that greets visitors and residents of the Town Square. Revised: January 2016 VARIANCE REQUESTED - MONUMENT SIGN - SIGN C Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. If we place Sign C on the wall or canopy in this area, it will not be readily visible to guests on the sidewalk. Also, we want to direct patrons to the main entry. Placing the sign above the door or window on this side of the building may lead guests to want to enter from this side of the property, so literal enforcement may confuse guests and complicate operation of the restaurant. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. MOXIES is a national chain that seeks cohesiveness in its brand identity. This monument sign is a part of the typical entry and patio design for these restaurants. The specific location of this property at the rounded corner of the intersection means guests can approach the front door from two directions and the signage needs to appropriately address both approaches. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. There is a glass rail at the edge of the patio that can be interpreted as a type of 'wall' and the monument position reinforces the edge of the patio. Although we are asking to disconnect this sign from the building, it will still feel as though it is part of the restaurant and not be completely free standing. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. The lower monument sign will enhance the urban 'downtown' character of the town square by creating visual interest at pedestrian eye level. Also, the lower monument sign is in harmony with other low elements on the patio like the screen wall and railings. In this position it will not be a nuisance to any adjacent property given that it is illuminated. Revised: January 2016 VARIANCE REQUESTED - FACE LIGHTING - SIGN A Demonstration Please demonstrate that the following conditions are applicable to the reouested sign variance: That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. Internal illumination of the canopy fascia sign is needed to make this sign visible at night to cars at the intersection of Central and Main Street. Halo lighting the letters will not provide sufficient illumination for auto -oriented traffic. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The restaurant sits at the corner of a high traffic intersection. Most of the signage we are proposing is pedestrian oriented but this one sign needs to speak to guests arriving by car. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. We are not illuminating the entire face of the letter and only seek variance for the white border around the letters. Aside from strategically locating the light source, we are also placing the sign high on the canopy so it does not cast glare into motorists eyes. The sign faces a parking lot / intersection and no residential property. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. The canopy fascia sign speaks to the intersection of Central and Main Street to which we are adjacent and is auto -oriented. The sign will be well designed and pleasing in appearance and will be integral to the design of the luxury patio dining space that we will build on this corner. Revised: January 2016 VARIANCE REQUESTED - SIGNAGE ON BARRICADES - SIGN E Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. RPAI is requiring us to cover the faces of the barricades with graphics. The barricades are required for the safety of pedestrians walking around the job site. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. RPAI requires full face signage on barricades. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. Not having these barricades in place will create more of a sound and safety issue for adjacent properties. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. The proposed graphics will be very attractive and generate interest and excitement about the new development. Revised: January 2016
