Variance Requests
1.Subdivision Ordinance No. 483, as amended, Sections 8.01(A) and 5.04, require that every
lot shall front on a public street (which includes public utilities). The applicant is requesting
approval of a variance to allow the lot to be accessed by a private driveway with a private
water line.
2.Subdivision Ord. No. 483, as amended, Section 8.01.D requires all side lot lines to the
perpendicular to the right of way. A variance is requested to allow the side lot lines as
shown.*
3.Subdivision Ord. No. 483, as amended, Section 8.01.K prohibits panhandle lots, also known
as flag lots. A variance is requested to allow the panhandle lots as shown.*
4.Subdivision Ordinance No. 483, section 5.06 requires minimum 5’ sidewalks along both
sides of all public and private streets. No sidewalks are proposed.

Supermajority Vote Requirement
Texas Local Government Code Section 212.015,Additional Requirements for
Certain Replats,Subsection (c)
If the proposed replat requires a variance and is protested in accordance with this
subsection,the proposed replat must receive,in order to be approved,the
affirmative vote of at least three-fourths of the members present of the municipal
planning commission or governing body,or both.For a legal protest,written
instruments signed by the owners of at least 20 percent of the area of the lots or
land immediately adjoining the area covered by the proposed replat and extending
200 feet from that area,but within the original subdivision,must be filed within the
municipal planning commission or governing body,or both,prior to the close of the
public hearing.
