SB Item 4 - Southlake Tech CenterCase No. SV19-0007 S T A F F R E P O R T August 2, 2017 CASE NO: SV19-0007 PROJECT: Sign Variance for the Southlake Tech Center EXECUTIVE SUMMARY: SC 1363 Brumlow, LLC is requesting approval of a variance to Sign Ordinance No. 704, as amended, to allow 8 sign panels on the proposed monument sign located at 1363 Brumlow Avenue, Southlake, Texas. REQUEST DETAILS: The Southlake Tech Center is generally located south of intersection of Hart Street and Brumlow Avenue on east side of Brumlow Avenue The monument sign is proposed to serve the 7 flex office buildings on separate lots within the development. Sign Ordinance No. 704,as amended, allows a maximum number of six (6) sign panels for any business monument sign located along a street. The applicant is requesting one (1) business monument sign with eight (8) sign panels that will serve all seven (7) sites; forgoing the ability to have any monument signage on the remaining lots. The monument sign is proposed to be located on Lot 1. The proposed monument sign meets all other regulations for a monument sign. September 3, 2002; City Council approved at the 2nd Reading (7-0) subject to Revised Site Plan Review Summary No. 3, dated August 30, 2002, according to First Reading with exception of requirement of common access easement on south property line; common access easement removed (ZA02-046). April 3, 2014; At the Planning and Zoning Commission meeting, the applicant withdrew an application for a zoning change and site plan and a preliminary plat under Planning Case Nos. ZA14-012 and ZA14-015. February 3, 2015; City Council approved the development; noting the applicant agrees to general office uses, only to include laboratory and medical uses that do not have patients, and agrees to take out banks as uses; limit the I-1 uses to light assembly warehouse uses only; applicant agrees the dumpsters to be masonry to match building materials; agrees to give up 4 parking spaces fronting Brumlow Avenue and add 2 landscape islands; will add additional landscaping along Brumlow Avenue and to include a berm; the south fence shall be brick masonry with a base under the fence; agreed to granting a variance to the roof pitch accepting a 4:12 roof pitch for all buildings; granting the variances to the lotting requirement, driveway stacking depth, and driveway spacing; and including the Staff Report dated January 26, 2015. February 3, 2015; The City Council approved the Preliminary Plat and subject to the Staff Report dated January 26, 2015 (ZA15-018). April 9, 2015; The Planning and Zoning Commission approved the final plat on the consent agenda. June 30, 2015; the plat was filed with the county. Variance Criteria: 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council.
