Greenlee Business Park Addition (Lot 1A-R and Lot B-R, Block 1) - Permanent Sanitary Sewer Easement PERMANENT SANITARY SEWER EASEMENT Lot 1A-R and Lot 1B-R, Block 1 of the Greenlee Business Park Addition TO THE CITY OF SOUTHLAKE TARRANT COUNTY, TEXAS THE STATE OF TEXAS § COUNTY OF TARRANT § That Metroplex Acoustical, Inc., a Texas corporation, ("GRANTOR" herein), for and in consideration of the sum of Ten ($10.00) Dollars and other good and valuable consideration in hand paid by the CITY OF SOUTHLAKE, home rule municipal corporation of the County of Tarrant, State of Texas, GRANTEE herein, the receipt and sufficiency of which is hereby acknowledged and confessed, does hereby grant, sell and convey unto the said GRANTEE a permanent and perpetual easement for the purpose of installing, repairing, maintaining, altering, replacing,relocating, rebuilding, removing, and operating a sanitary sewer line, not exceeding ten inches (10") in diameter and appurtenant facilities (collectively, the "Sewer Facilities") in, into, upon, over, across, under and through all that land in Tarrant County Texas described as follows (the "Easement Area"), to-wit: A fifteen foot (15.0') wide permanent sanitary sewer easement containing approximately 0.038 acres through Lot 1A-R and Lot 1B-R, Block 1, GREENLEE BUSINESS PARK, an addition in the City of Southlake, Tarrant County, Texas, according to the plat thereof recorded at Instrument No. D200091820, Plat Records of Tarrant County, Texas, with property address of 2030 E. Continental Blvd, Southlake,TX 76092,and as more particularly described in Exhibit"A",and shown on Exhibit"B" attached hereto and incorporated herein. together with the right of ingress and egress as necessary for such purposes. Prior to the execution of this Permanent Sanitary Sewer Easement, GRANTOR has installed various improvements in, on and under the Easement Area, including without limitation landscaping, landscape irrigation, driveways, fire suppression water line facilities, water service lines, sewer service lines, data and communication lines, sidewalks and concrete parking surfaces (collectively,the"Grantor Facilities"). GRANTOR reserves unto itself and shall have the right to use the Easement Area for purposes of: (i) access to and from the buildings and other improvements now and hereafter situated on said Lot 1A-R and Lot 1B-R, Block 1, of said GREENLEE BUSINESS PARK, (ii) maintaining, reconstructing, reinstalling, relocating, replacing the Grantor Facilities, provided that when doing so, GRANTOR shall use reasonable care and expend reasonable efforts not to damage the Sewer Facilities installed pursuant to this easement, and further provided that should GRANTOR remove, abandon, or relocate outside of the Easement Area any of such Grantor Facilities,such removed,abandoned, or relocated facilities will no longer be considered as part of the allowed Grantor Facilities under this Easement Agreement, and (iii) such other uses that do not materially interfere with the sanitary sewer facilities of GRANTEE situated in the Easement Area. GRANTEE shall repair all damage and injury to the Grantor Facilities now and hereafter situated in the Easement Area caused by the installation, repair, maintenance, alteration, replacement, relocation, rebuild, removal, and/or Sanitary Sewer Easement Page 1 of 3 operation of the Sewer Line by GRANTEE after the effective date of this Permanent Sanitary Sewer Easement. Grantor Facilities that are temporarily removed for periods not exceeding 6 consecutive calendar months for maintenance, reconstruction, repair, replacement or relocation within the Easement Area will not be deemed removed, abandoned or relocated. GRANTOR covenants and agrees that, with the exception of the Grantor Facilities, GRANTOR and GRANTOR's heirs, representatives, successors and assigns shall at no time erect, place or construct, or cause to be erected, placed or constructed in, into, upon, over, across or under any easements granted herein any temporary or permanent structures which materially restrict, interfere with or prevent the uses granted to GRANTEE in this Permanent Sanitary Sewer Easement. It is further agreed that GRANTEE shall have the right to excavate and fill upon the Easement Area and, with the exception of the Grantee Facilities, to remove from the Easement Area, any fences, buildings or other obstructions as may be placed in the Easement Area after the effective date of this Permanent Sanitary Sewer Easement. It is further intended that the sanitary sewer easement granted to the GRANTEE in this Permanent Sanitary Sewer Easement shall run with the land and forever be a right in and to the land belonging to GRANTOR, and GRANTOR'S successors and assigns, and said grant is expressly excepted from any right of reversion of said premises under any prior deeds in GRANTOR's chain of title.
