Item 6ACase No. ZA19-0037 S T A F F R E P O R T August 13, 2019 CASE NO: ZA19-0037 PROJECT: Specific Use Permit for Southlake Carroll Dragon Homecoming Parade EXECUTIVE SUMMARY: Carroll Independent School District is requesting approval of a Specific Use Permit for a Mass Gathering for Southlake Carroll Dragons Homecoming Parade on property described as Grand Avenue District and Phase I of Southlake Town Square, City of Southlake, Tarrant County, Texas; and generally located between N. Carroll Avenue, E. Southlake Boulevard and State Highway 114, Southlake, Texas. Current Zoning: “DT” Downtown District. SPIN Neighborhood #8. DETAILS: The purpose of this request is to host the Carroll Dragon’s Homecoming Parade in coordination with Southlake Town Square and the City of Southlake. Beginning in 1999 and prior to 2008, the Homecoming Parade was successfully held in Southlake Town Square without the carnival fundraising component (no SUP was required). In 2008, the Carroll Senior High School Student Council made a decision to move the parade to Dragon Stadium in order to add the fundraiser and pep rally components to the event. In 2013, the event was brought back to Southlake Town Square in an effort to rekindle the missed spirit of community involvement within the unique Downtown environment of Southlake Town Square and has been successfully held annually since. The applicant is requesting a renewal of the current SUP making no logistical changes to the parade route, carnival or pep rally set-up for a 5-year approval period. Details of the 2019 Homecoming Parade event include: • Homecoming Parade date: Wednesday, October 23, 2019 • Staging of floats in parking lot north of Hilton Hotel beginning at 9 a.m. • Tent/Table/Chair setup in Family Park complete by 10 a.m. • Vendors/Sponsors/Clubs arrive to begin setup after 2 p.m. • Carnival setup complete by 4 p.m. • Carnival begins at 4:30 p.m. • Parade begins at 6:30 p.m. • Pep rally including presentation of court begins immediately following parade (approximately 7:15 p.m. on Main Street in front of City Hall) • Stage Homecoming Court (with parents) in lobby of City Hall • Announce King & Queen and present from City Hall 4th floor balcony • Event concludes by sundown approximately 7:45 p.m. • Teardown/Clean up/Tent pick up 8 – 9:30 p.m. On August 8, 2019, the Planning & Zoning Commission unanimously recommended approval for five (5) years and as presented. Other mass gathering events in Southlake Town Square: • Art in the Square; held annually since May 2000. Current approved SUP is valid in perpetuity. • Showcase in the Square; held annually since June 2012. Current approved SUP is valid until July 1, 2019. (5-year approval) – renewal due prior to June 2020 • Oktoberfest; held annually since October 2002. Current approved SUP expires June 4, 2024. (5-year approval) • Southlake Green Day; held annually since March 2009. Current approved SUP valid until January 20, 2020. (5-year approval) • PKD Walk / 5K Run; held annually since 2004. Current approved SUP valid until October 1, 2019. (5-year approval) • Home for the Holidays; held annually since November 1999. Current approved SUP is valid in perpetuity. • Stars & Stripes; held annually since July 1999. Current approved SUP is valid in perpetuity. PLANNING & ZONING COMMISSION: August 8, 2019; Approved (7-0) subject to the Staff Report dated August 2, 2019 for five (5) years as presented. Expiration date immediately following the 2023 event. STAFF COMMENTS: Due to the limited scope of this request, no plan review was generated. The City Council shall consider the following in determining whether to grant a Specific Use Permit for a mass gathering event according to the Comprehensive Zoning Ordinance No. 480, Section 45.14c, as amended: 1. whether there is convenient and safe access for the ingress and Case No. Attachment A ZA19-0037 Page 2 egress of pedestrians and vehicular traffic; 2. whether sufficient traffic control personnel is proposed to insure safety to all members of the traveling public, including pedestrians, along all public roadways in the proximity of the mass gathering and/or along which the public is likely to travel to reach the mass gathering areas shall be provided; 3. whether the mass gathering area is well drained and so arranged to provide sufficient space for persons assembled, vehicles, sanitary facilities, and appurtenant equipment; 4. whether sufficient illumination will be provided at night to protect the safety of the persons assembled; 5. whether adequate parking areas, including disabled persons’ parking spaces, shall be provided for persons arriving by vehicular means. If the promoter proposes to utilize temporary off-site parking, then the promoter the mass gathering event the off-site temporary parking area will not be utilized for purposes other than the mass gathering event; and 6. whether adequate provisions have been made for food supply, medical assistance, garbage disposal, water supply, parking, sanitation and toilet facilities, vermin control, and safety. 7. The City Council may establish specific conditions depending upon the nature of the proposed event and traffic, health and safety issues according to Ordinance 480, Section 45.14.a, as amended. • Confirm event details with the City Staff regarding logistics for use of town hall facility. • Please note that any or all of the Mass Gathering regulations may be applied to your event request. See Zoning Ordinance 480, as amended, Section 45.14. • Prior to the event, provide a plan of the event area to the Building Inspections Department showing tent sizes, tent types, etc. Dependent upon the type and size of the tent(s), a permit may be required and an inspection, after installation, conducted by the Fire Department. • All food vendors associated with the event(s) shall be required to obtain necessary Tarrant County Health Department permits. • The applicant understands that a review of future planned CISD parades under this Specific Use Permit will require city staff approval at least 30 days prior to the event. CARROLL AVENUE, SOUTHLAKE, TEXAS, BEING DESCRIBED AS GRAND AVENUE DISTRICT AND PHASE I, SOUTHLAKE TOWN SQUARE, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT “B” AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a mass gathering for Southlake Carroll Dragons Homecoming Parade has been requested by a person or corporation having a proprietary interest in the property zoned as “DT ” Downtown District; and, WHEREAS, in accordance with the requirements of Section 45.1 (36) of the City’s Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a mass gathering for Southlake Carroll Dragons Homecoming Parade, on property within the City Of Southlake, Texas, generally located between E. Southlake Boulevard, E. S.H. 114 and N. Carroll Avenue, Southlake, Texas, location being described as Grand Avenue District and Phase I, Southlake Town Square, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit “A”, and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions Case No. Attachment D ZA19-0037 Page 2 set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: SECTION 2.
